    • Morning,  I have recieved a reply from my request for information. They have replied with the credit agreements for my 118 loan and two Captial One cards.  They have said thay as Vodafone is a telecommunications account it is not regulated so the original creditor is not obliged to provide a copy of the agreement.  What are my next steps?  Thank you

    • Thanks all. Think I have come to a plan dx please correct me if I am getting you wrong but I am going to go down the route you suggest. simply stop payments for now until I receive a DN and it gets marked on my file. Then contact each lender and start making token payments to each one. i then assume most like they will then at some point sell to DCA. Once they are sold I’ll be coming back to see how best I deal with it.  Let me know if I am making some error in judgment or missing anything with my plan

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, recently had stitches removed in my local hospital, all went well until the nurse went to cut tape used to seal the wound and she missed the tape and cut a small chunk in my arm. 

I was in a bit of shock at the time, she took a picture said sorry and said she was surprised the scissors were so sharp as they are supposed to be blunt. 

Who should I complain to and would I be likely to receive any compensation. Thanks

You can probably complain to their line manager and you might be able to get a little bit of compensation but also you may well cause a disciplinary action and the loss of a job to somebody who is doing their best in a system which is under resourced and under pressure and who is probably under stress and underpaid and is probably now rather stressed and frightened about what might happen because of an unfortunate accident.

Do you know if they were somebody who is married and who has children or who has difficulty making ends meet?

You can complain to the NHS Trust that runs the hospital, either directly or contact their PALS service  (Patient Advice and Liaison Service). Details will be on the hospital website.

Compensation? Doubt it but you could ask if your injuries are serious enough to justify a personal injuries claim. If you are going to pursue this for money you need to get an independent medical reprot now to confirm the injuries you have suffered (which will need to be a medical report at your own expense).

I think the idea of compensation is a bit much.

It's not like the NHS goes handing out money for that like nothing. You'd have to submit a personal injury claim through the courts against the trust.

Even then, for the very little you'll receive for a small knick on the arm (if anything), you must question whether the time spent is worth the trouble.

As @BankFodder said, think about the other person here. Is it worth having an overstressed and underpaid nurse go through disciplinary and potentially being laid off due to a small knick on the arm?

As a friend, who is was a medical negligence lawyer, explained to me. Despite all the compo ads for motor vehicle claims, medical related injuries rarely result in much if any compensation unless they are serious. There is also an assumption that during procedures minor injuries may occur and that the patient has explicitly or tacitly accepted that risk. For example, during colonoscopy it is possible (though rare to tear the colon wall. My friend also said she wished people would just accept minor mishaps. 

 

On a personal note, I think I probably would not bother escalating this because the nurse clearly regretted it and gathered evidence against herself by photographing it. 

 

Finally. During an examination a nurse tipped my bag over breaking my tablet. Did I care? No. I was glad of the free service from the NHS and a few days later I dropped off some staff room essentials for the team that treated me well.
