    • Thank you, I was been told that it’s a serious crime if I shoplifted above £200, (this time £500, I gave the thing back+ last time probably also around £500 which I didn’t give back).. and I admitted to them that I sold those things at very low price to pay for food and stuff.  That’s why I was worried..as it wasn’t my first time.. I also did it in John Lewis in the city I live, but when they asked me I said I didn’t steal things from it as I don’t wanna get caught in my city. But I don’t know when they upload my pics in the system will they recognise me and think of me a professional shoplifter than against me… so what happened about the fraud was that what there was a phone call told me that my visa has problems etc due to I helped bad people do money laundering etc. I said I didn’t then they tried to ‘control’ me and many things happened to make me believe what they said… as soon as I gave them the bank details I lost all the money in it.

    • Hello I would be really grateful if you could give me your guidance please regarding a Notice to Keeper I received requesting payment of £100.00 for parking. The driver of the vehicle parked in Starbucks for a period of 38 minutes, thinking that there was 1 hour free parking according to the signage. They did not leave the Starbucks area of the car park to visit McDonalds. Starbucks was closed at the time so they were not able to purchase anything from Starbucks, which was the intention. Today is the last day to make the payment of £60.00 but I am reluctant to make the payment as I feel it is a total scam.  I would welcome your guidance and advice for next steps. Thank You   (I haven't added any copies of the NTK as I was not sure if it should be shared at this point?)
    • you will not and CANNOT be fined/goto jail/called on by the police. all that is now well over and you've simply been told those things to frighten you by a trumped up security guy. ignore it, stay out of that store, nothing anyone can do..END OF! 100's of like threads here to read type in RLP. when were you scammed out of this £35k, and who by? dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

They are on a hiding to nothing with that one as LFI indicates No POFA compliance so cannot be transferred No appeal people out themselves inadvertently as Driver with appeals quite often.

So long as you didn't out yourself as Driver,

"5. The driver agreed to pay within 28 days but did not; D is liable as the keeper. Despite requests, the PCN is outstanding. "

is fatal as no POFA compliance.

That should also serve to let them know their claim is in for a bumpy ride through the system, they have 2 strikes with the Legal Representative Fee already.

Yes travel plans should be changed if possible, as FTMDave says you would definitely lose if yo don't turn up, they have made such a mess of this they shouldlose hands down.

Another part is para 13 where they try to go behind Beavis as the £100 was judged to be inclusive of debt recovery and the extra £70 is a Penalty in all but name, but as stated by other's the signage is pants.
