Hand Held Speeding Cameras

Does anyone know if there is any action that can be taken if you are caught speeding by a Policeman with a hand held camera? My partner was stopped yesterday and was told he was doing 45 miles an hour in a 40 mile zone. He knows he was not doing this as his speedometer was showing 42 miles at the time and he also had a sat nav in the car which indicated he was actually doing 39 miles per hour. The police aren't going to prosecute him for this, they just asked him to produce his documents, but it did make me wonder whether we just had to accept whatever the police say when we are caught speeding in this way, without having any evidence to show what the actual speed was.

No, you don't have to accept what the police say, however if they don't plan to prosecute, there's not much you can do. If they caution you, you can reject this providing a sworn statement with data from your GPS showing your speed and track (make sure you download this and keep the file safe). Because the speed their laser gun recorded was only 45mph that's 1mph over the limit they set for seeking prosecution, so they'll probably let it go, just wanting the licence etc to ensure they can't get you on anything else.

but i remember that, if you are caught you can ask for a calibration report for the camera to make sure its functioning properly, and some other stuff

The Freedom Of Information Act was amended with regards to asking for information to be provided prior to going to court - items such as calibration certificates, training records etc are now only provided once in court and not before.

 

Hand held cameras are now much more efficiently used, because the police have further powers to ensure that loopsholes such as not being clearly marked etc are not exploited or used in a defence.
