    • The ISA quoted vehicle CY08JCJ entering 12.49 and exiting 14.19 this is not my sons vehicle. These times also vary from the two payments made?
    • Not completely black and white. ICO says if you ask for the information to be sent in a particula way, in your case electronically, then they should send in that way "if possible". So I suggest making that request firmly. I would guess if they actually only hold paper copies they'd be with their rIght to decline to scan everything for you. Or they could transcribe just your personal information.

I can also bring up that 1. they no showed this court in our previous mediation call and wasted all our time, and 2. they already settled in full with me last year on an identical parcel and case so we're going down the same road?
    • Regarding SARs - does the recipient provide hard or digital copies of info?  I sent out a request recently. All the info was digital and I'd like it sent digitally - for expedience -  but they want to post hard copies.  Can I demand digitally?  If it's hard then I will have to labour over scanning it all back in to my computer - which is a waste of my resources.  I had this issue recently with a lawyer - they said they had too much info to send by email. Yet miraculously found a way within 2h. (It would be useful to have hard copies too - but in terms of short-term follow up communication digital is best for me)

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Netty, when you get it, if you are going to save it then NS&I have some really good accounts with some very competitive interest rates - National Savings & Investments - The safest home for your money - if you've no intentions of saving it, then can I recommend the Nicolas Feuillatte Cuvee Speciale Vintage 1999 or 2000 champagne - only about £20 a bottle if you buy a case from tesco.com :D

Absolutely right - you're going to get the full amount with costs and interest. Stay focussed on that shining day when you open the post, and one of the letters is from DG saying that they're oh so very sorry, and that they're admitting all fault, and that they'd like you to have all your cash back... Well, 1 of 3 isn't bad!

hi everybody

 

i've decided to start on my second claim againt hsbc - from nov 06 to date lol. i know.... they can't close my account because i've beaten them to it already. i've entered into some interesting dialogue via email with my branch's customer credit services, who even though i've told her i have already filed one claim, seems content to let me do it again, this time sending her the breakdown of charges etc.

 

oh well...here we go again!

If i've been helpful in any way....then tip my scales over there!

i agree with you lats, i can only put it down to the weather. it's particularly bad in brum - where dg are so maybe they've been going home early because of the snow. wonder if peeps will get their offers on monday instead?

Hi Netty, I am on the same timescale as you and haven't heard a thing from DG. They did respond to my messages left at Rachels voicemail though. They confirmed they had received my breakdown and it was being dealt with. I think I will ring them next week.

How do you spell Rachel, Rachal, Racheal???

Thinking of emailing her as well.

You are unable to take any further action online on this claim.

 

The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly."

so, jump on the bandwagon - don't give them time to breathe "I see you are defending the claim - have you received my breakdown", next time:

"i will be submitting my a.q. shortly (not really) - any idea how long it will take your office to deal with my claim" - then: "anything i can do to expedite your dealing with my claim" bumpity bump - get yours to the top guys - send (fax) another breakdown with a little note: just in case you need another copy of my breakdown, please attach this to my file".

whatever and whenever - let's make them sick of you and want it out of the way before the aq is due. sod this new tactic of theirs - waiting until the aq is due and not filing - make them earn their money. and when they say "it is with the client" or "there is a 2-3 week backlog in dealing with the claims" just point out that they have already had 28 days to deal with it and filing the aq will be raising your price and wouldn't they like to clear out some of the outstanding claims to make room for all the new ones coming along - with all the adverse publicity the banks are getting - they had better get prepared for more claims, not less. don't get into any arguments or negotiations with them - just quick statements - probably get voicemail anyway - but ask them to return your call - get chummy with them, guys - now you can actually do something. always polite but firm. let's get these two done, three - rooster's too - who all was in that support group - first one to the finish buys the beers!
