    • Good Evening, I've got a fairly simple question but I'll provide some context incase needed. I've pursued a company that has operations in england despite them having no official office anywhere. I've managed to find a site they operate from and the papers there have been defended so I know they operate there. They've filed a defence which is honestly the worst defence ever, and despite being required to provide their witness evidence, they have not and have completely ignored the courts and my request for copies of it. I'm therefore considering applying to strike out their defence on the grounds the defence was rubbish and that they haven't provided any evidence for the trial. However, it has a trial date set for end of june, and a civil application wouldn't get heard until a week before then, so hardly worth it. However, my local court is very good at dealing with paper applications (i.e ones that don't need hearings, and frankly I think they are literally like 1-2 days from when you submit it to when a Judge sees it. I'm wondering if I can apply to strikeout a defence without a hearing OR whether a hearing is required for a strikeout application.   Thanks
    • I have just opened another bank acc with lloyds (i have a few already) After doing some research they may have some relation to tsb or be apart of the same group will this cause me issue if my salary is paid into my lloyds account? Also, if the debts do go into default and nothing is paid then after 6 years it all goes away? As the DCAs cannot do anything? I do want to start paying in like 3/4 months or do you advise I leave it if it goes into default? again sorry for all the questions, i am just processing everything

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

i think you are doing just fine - you've got a complete network of people wishing you well. give it a go when you are ready - every time i look at it it looks easier - you do the same - just keep going back - it will click into place when you get around to it - still plenty of time

 

how about a fax to dg - they might not see it coming!

and maybe, maybe, maybe - dare i say it - 3 day offer bonanza starting tomorrow???????? shoot, it's only tues, isn't it?????

i know i know i know.... i feel the warmth from everybody it's incredible!! and without all of you i'd have crumbled by now (maybe not crumbled altogeher - i'm not called mouthpiece for nothing lol).

 

it did cross my mind that dg might be p****d off enough with my name by the weekend that maybe..... just maybe they'll send something in the post - even a get lost letter would be nice!! i'll give it my full attention at the weekend tho - bits and pieces of family business to deal with up til then - 100% raring to go on saturday i reckon. i bet you'll be so glad when your 'wishlist' have been paid out!! long walks, pruning the roses round the front door - i hear you lats xx

i think i'll get it ready for the friday in any case!! managed to get a response from rachel tomlinson today - she just said - it's still with the client... . i did say they'd had enough time to look at it and wouldn't they like to get things moving before the aq's are due - and she just said to file it anyway!!

Hi all! Back from 3 days with work in Bournemouth... and no internet! How deprived did I feel?!

I also got a reply from Rachel today by phone. I asked where we were settling the claim and she said it was being looked into and she couldn't give a timescale. Asked if she had everything and she said yes.

What else can we do now apart from file the AQ?

HSBC HOLDINGS PLC (LEGAL DEPT) has a branch at 12 Calthorpe Place with 15 solicitors registered there. they are in essence the client at DG.

Netty, I think that is her stock answer, she told me exactly that on Thursday and today I received a letter dated 20th, increasing their offer by about £24.... still got a further £200+ to go before I will settle. So onwards and upwards!!

This is my first thread - I found info in daily mail last week so no doubt HSBC are going to be swamped with letters this week. However after reading the success stories on this forum I have just sat and gone through 6 years of statements which are accessible from the hsbc internet bank web page and calculated £2677.00 from my current account. That is shameful on my part for being so slack with my accounts and diabolical of HSBC to make so much money on some peoples financial misfortune or merely abuse their lack of knowledge. Anyway I am so eager to get this resolved I've typed the letter template, attached the summary of charges detailing dates and amounts and I have just gone on a mission with my dog at 1am in the morning to the post box. I have sent a letter to my branch and also a copy to Head Office, another will be sent to head office tomorrow via recorded delivery if I get me backside in gear in the morning, if not it will go on Friday. At least that will give them time to receive the first 2 letters and get cracking.

 

I am so excited - it's like a savings plan I didn't know about. I just hope it all goes through.

 

Thanks for the threads, they've been really usefull and I'll donate amounts if it pulls off ;-)

didn't ring them today, thought i'd give them some time to do something instead of trying to avoid me.. lol!!! however, it's friday tomorrow and that's when they usually pay a lot of peeps out, so they'll have some 'free' time to chat to me on the phone i reckon:)

well i'm not that optimistic for this weekend cos my aq's not due til next weekend, but if they haven't given me an offer at least by next saturday morning.... then i think the battle begins :confused:

maleo, i was traumatised last night in town!!! me and a friend went to see amy winehouse (brilliant), but when we went back to get in the car - it had gone! some cacksters had towed it away to the pound!!!

cost my mate £390 today to get it back - very expensive night all round
