Had a phone call today from the manager offering £1900 in settlement for a claim of £2300. Court in on 21st this month. I said "no" . was i correct or should i have excepted and closed the case?.

you did the right thing pogo they just like to see how far they can stretch you,they will pay it all before court there is no doubt about that.you would wonder why they bother for the sake of £400 why dont they just pay up and save all that grief.

The Northern bank is going to refund all charges claimed for providing I sign this. ( I quote) "I understand that once I accept this offer in settlement no further claims can be made in respect of these matters whether the losses are manifest or not yet apparent." What advise can you offer. Is this request legal?. Pogo

Its not illegal, its just like a contract of terms and no i would tell them to sod off and tell them you won't agree to that and you will continue your claim through the courts, have you already filled with the courts or are you only at the letters stage??

It is illegal. They can not make you sign away your right to access to justice via the courts system, which is what this amount to.

 

Furthermore, it is YOUR claim, they can not impose terms on you.

 

I suggest you write back and say that you will stop your claim on full and UNCONDITIONAL refund of the charges, and nothing else will do.
