I have had enough of halifax, they charged me £120 charges as i was over my overdraft less then £30 but in 4 transactions. I am going to get every penny off the swines now! I got all my statements, filled out a spread sheet and a request for payment. Just one question-- on the spread sheet it says about the first rate of interest "The first interest rate is for interest on unlawfully deducted items up to the date of service. You can use almost any rate you see fit" I don't know what rate to use??

Also am I correct in saying you don't charge any judicial interest unless you go to court??

You can claim the charges plus any interest debited from your account in respect of these charges. You can also claim 8% interest for each charge when you start MCOL. This 8% is calculated on each individual charge over the length of time that charge has been on your account. I believe that is all the interest you are permitted to claim. I personally have left off the interest debited part of my claim as it just seemed too long winded to work it out and I think it would have only amounted to a few pounds.
