It sounds like you have had a bit of a rough ride with everything over the last few years or so...unfortunately i dont feel able to offer you any sound advice other than, maybe go and see someone at your local CAB, if you havent done so already, they may be able to mediate between you and your ex, to try to get hime to sign paperwork etc, negotiate with your creditors, or maybe point you in the right direction or other specialised help in these matters...

Im sure someone will be along shortly that might be able to answer at least one of your problems..sorry i cant help more.

Is this a fact? I've had 3 or 4 attempts to repossess me over the years having had my mortgage since the early 90's. Each time with all the legal costs being dumped on my account..are you now saying I shouldn't have had that when each and every time I had no representation? I just haggled away myself until they 're-arranged' my arrears. Which legislation because I am going to be sending a letter out toute suit if it's true. I can't believe we keep finding stuff out like this, no wonder the place is in such a diabolical mess with all these scams going on...

I have just been whittling away at my statements, listed all the legal charges, and am going to request true copies of all invoices and full breakdown and explanation of costs.(just in case they forget to send it with my anticipated SAR. Because these costs are not even consistent, for example we had a hearing suspended due to medical issues with my husband, they (crapstones AND hand in glove solicitors) charged us £150.00+ for not having to turn up (courts faxed them paperwork through in plenty of time) then when we appeared 3 weeks later at the court hearing they charged us £130.00+. Iam just waiting on my new statement, as i know arrears balance has shot up anothe r £1.000 + since begining of feb...cant wait to see what they have added this month ?

Am also sending a letter regarding all the arrears management fees that have been applied too, especially interested as to why they added them a week after we had cleared one lot of arrears and balance was actually in credit ??

Am also sending a letter about the so called administrative errors that keep happening at the moment, love these letters, they dont actually explain what this was and how it has come to be, funny they make administrative errors to my expense again....These ar*e wipes will wonder

why they opened up my can of worms!!!!!!!:mad:

I had the same about 3 weeks ago when I got a call on a Sunday. I too will be sending a letter but have not had time as of yet. Let me what they say and I shall do likewise. I doubt they will care. They recently failed to comply correctly with an SAR so i wrote to them saying I give them a further 7 days to comply as a goodwill gesture otherwise I shall obtain a court order obliging them to. Guess what, they ignore me so I am going to be issusing proceedings within the next week.

 

For some reason, we haven't had any phonecalls at all.....in fact its quite worrying that all seems to have gone quiet from them, eerily quite...

Anyway, they have failed to comply to sar, have given extra week, still no sar...so we to have filed LBA today, by recorded...will leave it till about Weds, due to easter break, and if still none compliance, then will issue court proceedings.

Also sent about 3 other formal complaint letters also today, all under seperate recorded delivery..we know we cannot trust them, to not loose any!! can we.

Reading pages 199 - 220, i thought of you, and how this may help your cause when you go back infront of the judge, it may be worth printing and forwarding on beforehand...it helps explain the securitisation, the wrongdoings with the lRA act 2002 etc...

Keep the pressure up on them. I do believe it's beginning to tell. They will not respond to SAR, even with CPR 31.6 if it's already in litigation.

 

If they hadn't been so quick to jump down people's throats they wouldn't have had all this. They must have expected some kind of reaction, but they don't seem that prepared for the one they got.

 

 

The key at the moment is to cast enough doubt before the DJ on the CB securitisation stuff but also to go for other angles such as UTCCRs, CCA 2006. I'm with smarterchick on this one. The door isn't open yet but we should definitely keep knocking. We have only have to get lucky once, they have to be lucky ad infinitum, and the odds are they won't be.

 

 

The reason i posted the CB banking crisis link up and suggested LD, forward a copy to the DJ, who i believe was interested in the LRA aspect of LD'S case adjourned on certain reasons to do with the LRA, so i thought this may help little dotty bring this aspect to the DJ'S attention as we are all well aware they do not quite understand it..this is only my opinion though, please correct me if i am wrong.

I'll put my main points on a new thread regarding Mr Malek and SPML but I'd like to ask anyone that has a mortgage with them if they have have had a letter from Capstone dated March 2nd 2009 regarding a review of,

 

'administrative errors which have affected your account'.

I received one of those too in march, as you will have seen on my thread earlier !! Prior to this one i also received one in approx Dec/ Jan or thereabouts....

I agree with you LD, the more this is publicised the more chance we have of fighting it..

I would think that there is nothing to mull over, when you are faced with loosing your home to these morons we are dealing with.

I for one have spoken to the media, a couple of weeks ago, regarding another lender with a 2nd charge on my home.

Having done some 'googling' in relation to that journalist, who was working for a very well known financial news channel on cable/satellite, and noticing they had certain interests in reporting on Lehmans/spml, i dropped it into the conversation, certain things i was up against with my main lender, and if they wanted to speak to me again regarding these issues, they were free to call me anytime. I have kept hold of their email address, to use at a later date, when i have dealt with some more pressing issues.

Crapstone, posted up on one of the threads to say one of these sites were running a free trial, and it might be worth our while joining, but staggering it so we could get maximum benefit from it.

In the 2nd paragraph,

"under an innovative structure that allows lehman to issue future Eurosail transactions with minimum documentary changes"

 

Reading between the lines, could this mean they dont have to inform the debtor and the LR of any changes in relation to the cecuritisation of the mortgage?

But have to say that it is interesting to see that there is "master" documentation in place which means that the essential terms of all the Eurosail transactions will be the same. Excellent and handy to know. So it doesn't matter which Eurosail SPV your mortgage is in, the documentation is essentially the same. The only things that will change between each of the various securitisations is the figures, dates and some other economic details etc.

Hi all,

 

Just had SAR back from Capstones minus anything to do with securitisation. The SAR was signed and requested for by both mortgage holders yet they have only addressed it my OH and have blacked out all my details! SNAP, ME TOO SAME THING HAPPENED THIS WEEK!!

 

They will not provide MIRAS details as they do not hold any relation to the loan. They will also not pride any agreements between lender/broker/packager as it's not considered data relating to the account holders! FOLLOWED MY GUT INSTINCT ON THIS ONE, AND HAVE JUST RECENTLY SENT DSAR TO PACKAGER AND BROKER!!!

 

Although there is a reference to SPSH First charges in 2007 and this changes to Mortgage Funding 2008-1 BL in 2008. couldnt find anything relevant in mine..will carry on scrutinising it!!

 

Despite Capstone always denying that they had been sent a payment in 2007, it is clearly listed on their computer log that they received an 'unsigned' cheque. From their own records of letters sent they have never returned it as I would have expected them to should that have been the case. Looks like someone has been telling porkies and trying to put the blame on us for failing to pay.

 

Like we have all said before, the sleeze balls cannot and should not ever be trusted...

Just scruitinising the P*ss poor excuse for a dsar...Altough i feel highly honoured as Borrower 2 to have received my copy before my OH Borrower 1, dont know what he has done to upset crapstone..

 

On my mortgage offer it states under the heading of "BRANDED LENDING"

"Solicitors and applicants to note that this Mortgage offer is issued by MORTGAGE PLUS, however the monies will be provided by Southern Pacific Mortgage Limited, who will register first mortgage over the security".

 

Now My broker used a packager called PRAXIS, whom have suddenly (This last month) been rebranded under Melton Intermediary services,(melton mowbray building society) and moved offices...

Praxis shared the exact same address as Mortgage plus which is a trading name of Mortgage master, reg no 2966272, whom have a strike off pending at companies house, are in administration etc..

 

What i want to know is...why Mortgage Plus are making the mortgage offer (which from previous threads, this offer is classed as the contract IF signed charge attatched?) Then why was it not mortgage plus who brought reppo case to court?

 

Thoughts anyone?

we have experienced similar problems to Crapstone, we provided our signatures, and also put a mark through both in a different coloured pen... i am sending copies of all this to the ICO, with copies of their letters that state we didnot, comply with their signature authority request, even though we have proof it was signed for, along with the copies of the blatantly obvious statement on the mostly blacked out dsar that they had received it, but oh signature doesnt match???anything they have!!!

We can play silly buggers too, just like them...but my patience has worn thin now, so its a case of direct to ico, fsa and fos now...they might realise that they cannot keep treating people in the manner that they are!!!

i will also be using the letter template that eie has posted up here somewhere...

Funny they can only manage to send, one copy of libor rate change letters addressed to us both when they want their money!!!

I think i will send another letter requesting my OH's dsar, and then hit them with a demand that we want a copy of each letter they send in duplicate!!!!

It's now being administrated by Price Waterhouse Coopers. And it's a real effing headache because no one really knows what to do with it all especially as the investors in the notes are screaming bloody blue murder. The FSA keep asking the FOS to delay action on behalf of the investors! We are nowhere in the food chain of priorities. My guess is that it will all end up with the fat cat of barclays.

 

Price waterhouse coopers!!! they too are under investigation into their handling of the cattles fiasco... like you say EIE, THE FAT CATS BARCLAYS AND RBS:-x
