I understand that if I have had

no contact for over 6 yrs the debt

becomes unenforceable and is

statute barred.

So how would I go about reclaiming

the charges,as,if I understand correctly,

sending them S.A.R or even C.C.A

request letter to the D.C.A would restart

the 6 year time counter.

any info would be appreciated

According to B/card (even though there's some considerable doubt about that), they only introduced charges mid-01. Therefore, you wouldn't have charges, would you?

 

Secondly, even if B/card weren't being totally pig-headed about sending out the information (which they are), I doubt that they will have kept the information going back further than 6 years.

 

Thirdly, even if you could get the informtion and you had been charged, is the amount of money that you were charged MORE than the debt you are avoiding? Because if it's not, why on earth would you want to re-open that can of worms? Whatever you reclaim would get swallowed straight back by the debt, and you'd have to pay the reminder. :-?

If they're still chasing you for the debt then send them a CCA for a true signed copy of the contract. Without the contract the debt is unenforecable (I think) and chances are they cant provide it
