    • Hi all, Okay, just received a claim form from PRA.  The Court is Northamton. The claim is over 5k. They state the original agreement for the credit card was in 2000. What do you advise is the best next steps ?    
    • CEL are idiots, you'll be on a list of non-payers and they'll just automatically have sent out the LBC without bothering to check that the matter has already been dealt with by the courts. It depends what you want to achieve. 1.  If you want to get rid of them do as dx says and also add a blistering letter warning them that'll you'll smash them for costs galore if they're so damn thick as to take the same matter to court twice.  2.  If you want to annoy them and waste their time then ignore the LBC in the hope that they really will start a new court claim - that would lead to humiliation galore for them but also of course eat up your own spare time.
    • Trust everyone has been great.    Here is the latest update on this. After resubmitting all documents on April 12th, they acknowledged receipt of the documents I sent and I waited 15days.    30th of April I got an email from them saying they needed more documents. The documents I provided on shows proof of funds for all money that came in my name through the third party apps and they did highlight these credits as “seen” they showed me other credits on the account that’s not in my name.  About 22 of them, was asked to provide documents relating to each of these transactions “bank generated receipt or bank statement from each person”   I was able to contact and get receipts/statements for at least 20 of these transactions. I sent them 1st of May and called to confirm they got them.  Also, in the mail I explained each transaction and gave them all information on each credit, it was all naira exchange, I showed them my naira statement showing I sent each person an equivalent of the gbp I recieved in naira.    I was told I have to wait 15 working days again for a response and decision. It’s was 15 working days yesterday 23rd of May. I called today and I was told they don’t have any update yet so the lady said she’ll send a chase to the team and to call back next week.  It keeps getting frustrating. They gave a timeline and they are not going with that. Do I still need to wait or it’s time to do something else?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,

 

Have I made a mistake?

 

I had an unenforceable credit card debt from 2010 has been passed through the following companies:

 

Alliance & Leicester/ MBNA/AIC/Aegis/Wescot - Bank of America /Arrow Global/ Wescot/ Scotcall/ Vanquis Bank.

 

In 2011 Letter from Arrow Global said Scotcall is no longer managing your account. It will now be managed by Vanquis Bank on behalf of Arrow, who will be in touch to let you know contact details and offer you the "Avant Programme".

 

Never heard any more and 6 years later was offered a small credit card which I thought would help me rebuild some credit. The account is in order and I have managed pay it off each month.

But...

The card is from Vanquis Bank! and I have started getting letters and calls about the other account from AIC again.

 

It feels a bit uncomfortable.

Should I worry?

Your post is somewhat confusing....who was the OC for this " unenforceable debt " ?

Sorry for the confusion Andy,

 

The credit card came from Alliance and Leicester and was chased by AIC who said they would have to go back to MBNA to get the CCA. It was then passed from pillar to post and ended up with Vanquis. Hope that's clearer.

 

I didn't associate the name when I got a new credit card offered by Vanquis and I am wondering whether I have poked the wasps nest metaphorically speaking.

 

They obviously have my details confirmed. Why else would they chase a 2010 unenforceable debt. It could be a coincidence, but. My question is, does having a current credit card with them and an old unenforceable debt as well, pose me a threat do you think?

I was wondering whether I should write and remind them that it is SB?

 

I guess the effect of my debts, and being chased for years, has made me a bit jumpy.

I have as little to do with banks and debt as I can; except for this one limited credit card that I only use if I can pay it off each month. "Casting the money lenders out of the temple," makes perfect sense now.

 

It is a better way to live and I'll do without rather than go back to borrowing.

Arrows don't pass debts to vanquis

More likely sold the debt to provident and you got a new start letter under their later name of vanquis

 

SB,d anyway ignore them

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

God NO! Don't do their dirty work for them, let them either work it out for themselves, or waste their money and issue a claim, which will cost them, and you hold the trump card!

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!
