    • I have had a pre "warning" from TM Legal regarding 2 old debts stating they are going to send a claim form in email. I was sent a PAP form which i responded to on both but like a melt i sent their PAP pack back to them in my request for CCA etc using the CAG response form. I have not to my knowledge received a response for either. my question is, will sending their pack back cause me issues in the future? can I request they send this back to me?

    • We initially raised a complaint with the finance company who told us that as its over 6 months the consumer rights act won’t apply and we would need to provide evidence of the problem being there at purchase. As we have only just got the report from Mercedes we haven’t been able to submit this within their 14 day timeframe. Is this not the case then? Thanks

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Paypal-Does anyone have any problems with them.On Ebay or any other site.

 

I say this because in the last 4 weeks on Ebay my Paypal account has slowly closed on me.

Only able to access it at strange times of the day,say 12 midnight or perhaps as i get up early 4 or 5 am.

Then a few weeks ago i could not access at all.

Usually it says DNS server cannot be found,but everything else in the world can be found.

 

So i am selling on ebay and receiving payments paying postage but cannot access my Paypal account.

So really for myself Paypal has turned into a great big savings account with no interest.

 

I personally now have lost all faith in Paypal and looking for an alternative.

This might cost me sales but all my eggs are never put in one basket.Just in case.

Now this morning at 4-30 by some miracle i managed to access Paypal,i am honoured to have received this privilege.I will send them a letter thanking them.

Due to the way things have been going i withdrew my hard earned money and transferred it into my bank whom i have much more faith in.

 

This is what i have been checking each day as my frustration grew.Check it out if you feel so inclined.

See what some are saying here and there.And of course is it accurate.

Just checking my emails a few moments ago i received a email saying.

Your ΡayΡal account has been limited because we've noticed significant changes in your account activity. As your payment processor, we need to understand these changes better.

This account limitation will affect your ability to:

Send or receive money

Withdraw money

Also, you won't be able to:

Remove any bank accounts

Remove credit cards

Close your account

 

Charming,clearly they are the powerful ones and can do what they want at any time.

I am invited to go to the resolution centre and say what has happened.

If i manage ever to sign in again.

Why i withdraw my money instead of leaving it in their hands.

Anyway i just wondered what anyone else thinks of Paypal lately.

And what are the real alternatives to Paypal when on ebay etc.

I will for now ignore that email as i have just logged on once again to Paypal.

I noticed that i still have a small balance and the withdraw and deposit is still open.

I do not know what is going on.

Will leave it for now but something has been going on with Paypal for a while.

And i am not tech minded enough to understand it.

But many people have had issues with Paypal for a while.

Do they Paypal that is sometimes get attacked i do not know.

But if you rely solely on Paypal it could be worrying.

I will never ever use e-bay or pay-pal again, had bad experience with both and know a few people who have had several problems with both!

 

Neither are safe tbh so I heard!

Hi snowdragon.

I will stand by what i said about Paypal and possible problems for some when trying to log in etc.

 

However the email i received is clearly not from them it is one of those emails that try to get info out of you by hook or by crook.

Who sends these to people are clearly the trash that operate around the world and try to part people from their hard earned money.

It seems there are many doing the rounds.

I should have read it a touch slower.

The email was received OCT 6TH 2016 yet the last paragraph read.

Please log in to your ΡayΡal account and provide the requested information before April 27, 2016 through the Resolution Center. If we don't receive the information before this deadline or we notice additional significant changes in your account activity, your account access may be further limited.

Enough from myself for now.But if you have had any problems let others know.
