    • Hi everyone,  There were many topics on this issue in the past. May I please have an update if anyone managed to buy or sell the house with the leasehold air space on it? would the bank lend the mortgage?  If I was not informed about the complications when selling the house. instead, they told me that this would add value to the house and sell faster which is the opposite. Can I file the case and dispute it for mis-sold and misrepresentation?  I am in the year 9th and I was not aware of the issue until I wanted to sell my house. There has been no communication since I signed the contract. The company has never contacted or updated me on how much energy the panels generated how much I used etc.    This is a free panel from the government schemes, run by  Freetricity.   Thank you

    • Thanks in advance for advice! I was shocked to find out when doing a credit score search this weekend that I have a CCJ in my name. I've spoken to the courts today and have been told Vehicle control services have taken me to court for parking without a permit in my own allocated parking bay that came with my flat rental. The CCJ appears to be to the right apartment block but the wrong address.  It dates back to 2017. The judgement was passed in April 2021 without my knowledge of the ticket or the case ( presumably fine information was sent to the wrong address) I had already been taken to court by VCS previously for parking in my own bay and I won. It seems to me that this is underhanded behaviour from VCS as they had my address from previous interactions and had tried taken me to court for something that a judge had previously ruled on. I'm seeking advice on next steps. I was told by court that i can raise a dispute on the CCJ but I also want to appeal the case altogether. Should I be filing an  N244 Application Notice with an N161? I was told I should pay the court £303. Now that I've got home and had a look, there is a long list of court fees so I'm not sure which is applicable. I was also told the £303 is not refundable. Should I be filing a counterclaim or is that something that can be done at a later date. Ultimately I feel disgusted at having a ccj and then having to pay for the privilege of getting it removed. Any advice on how to make VCS pay for this would be appreciated!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello, I was made redundant(no pay i don't have like thousands of pounds, not even close it was a apprenticeship type vacancy so no redundancy pay) recently and im starting to do a show which allows people to donate (optional) which does not go toward any real life spending, purely towards the stream.

 

however i'm worried if this is benefit Freud in any way?

 

can someone explain this to me? thank you.

I expect that you have a duty to explain any income to them and then to act on their advice.

I've not started it, yet but im getting requests to allow donations, the donations are very minimal if i do like £5 - £20 and its way under 16 hours. but won't it be freud if i use it for my own persona living? if it goes directly towards the stream etc? I'm trying to find more information regarding it. (as it's donations)

My take on this: You are doing presentations (work in any other language) for which you are receiving a renumeration. Regardless of what you call this money, the DWP will see it as an income and is therefor declarable (as is the hours spent running the presentation).

 

If the DWP regard the money as income, then HMRC will want their cut in the way of income tax and national insurance contributions.

This is a tricky one. First off, yes, you would need to declare this to the Jobcentre - you must cover yourself against any possible allegation of fraud in the future, and no-one can accuse you of fraud if you told them about the money.

 

So how would the Jobcentre/DWP regard this money? Well, I think there are two possibilities.

 

They could be seen as "Voluntary Payments". These are fully disregarded (that is, you can keep them and they do not affect your benefit) but there is a question in my mind about whether this would apply. The reason for that question is that Voluntary Payments are normally given with no expectation of anything in return - say, for example, if a family member gives you £20 per week to help you pay for your car expenses or something like that. But in this case, the people making donations would be getting something in return - they'd be receiving your stream. And while I realise that you would still provide the stream for free to people who aren't able or willing to donate, I have a feeling that the DWP might still think that it doesn't exactly count as a Voluntary Payment by the strict reading of the rules.

 

So in the other case, it could be seen as income from self employment. In this case you would be allowed to offset the costs you incur in providing the stream against any donations you receive. You should, therefore, keep strict records of any such costs (ISP costs or whatever) as well as all of the donations you receive. There is also a small disregard applied to income from employment - £5 per week if you're single, £10 if you're part of a couple, £20 if you're disabled. So once you've deducted your costs from your income, you can keep £5 (or £10, or £20) of whatever is left, then the rest would be deducted from your benefits.

 

When you inform the DWP, the matter will probably be referred to a Decision Maker who will look at the case on its individual merits and determine how the money should be treated for benefit purposes.

This is of some interest , as i know someone who was quite well known for their you tube video channel , they i think asked for donations to help fund better equipment such as camera's and associated things like software to edit videos and microphones and they admitted that they claimed sickness related benefits as they had crones disease

So if they were able to prove they had spent money received via donations or as goodwill on things to further their you tube video content which is unpaid and accessed FOC to the public globally, how could they deem this to be income?
