    • I did call the police both in the UK and in my country but both of them said no way to get the money back now. I tried my best not panic but it indeed influenced my life in many ways, the only thing I could do is start therapies. It happened around February- March, so I started to do this shoplifting thing to cover my rent and everything from the end of March, it’s been a month now… today it my first time to get caught. I know it’s very very bad, I seriously didn’t want to do this at all. But luckily I just saw an message from HR, they asked me to have an online interview next week. I’ll stop this behaviour and wish my messed up life back to normal soon 
    • did you contact your bank about the fraud? contact the police , action fraud anyone in authority? have you done anything about it? when did it happen? dx  
    • You may have noticed that we have gone to the trouble of restructuring your posts to make them readable. I had to do it twice now.  My site team colleague has done it once. Posting long blocks of text make it very difficult for people to read especially using telephones. It discourages people who might want to help you.     • Thank you, I was been told that it’s a serious crime if I shoplifted above £200, (this time £500, I gave the thing back+ last time probably also around £500 which I didn’t give back).. and I admitted to them that I sold those things at very low price to pay for food and stuff.   That’s why I was worried..as it wasn’t my first time.. I also did it in John Lewis in the city I live, but when they asked me I said I didn’t steal things from it as I don’t wanna get caught in my city. But I don’t know when they upload my pics in the system will they recognise me and think of me a professional shoplifter than against me… so what happened about the fraud was that what there was a phone call told me that my visa has problems etc due to I helped bad people do money laundering etc. I said I didn’t then they tried to ‘control’ me and many things happened to make me believe what they said… as soon as I gave them the bank details I lost all the money in it.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Powergen cancelled my DD in 2003, denied I was a customer for the next few years so refused to set up a new DD.

 

I tried to register for their on line system & failed but due to this they didn't forward me a bill for almost 2 years.

 

Now they send me a demand for £1700+!!!

 

I sent them this letter -

Further to your letter dated 28th August 2006 and previous correspondence regarding the above account. In an attempt to resolve matters, I would like to set out a number of key points which summarise the situation and are beyond dispute.

 

•Payments were satisfactorily made to the account by direct debit until the order was cancelled by TXU Energi, as notified in their letter dated 25 January 2003.

 

•A number of attempts were made by myself to set up a replacement direct debit. These were unsuccessful as I was repeatedly informed by yourselves that I was not a customer.

 

•A number of part payments were made by me following the cancellation of the direct debit mandate, in an attempt to bring the account into line.

 

•No bills have been sent to me for almost 2 years – since November 2004.

 

It is clear to me and crucially, it would be clear to the industry regulator, Ofgem, that there have been failings on both sides since the original direct debit payments were routinely and satisfactorily collected.

 

Accordingly, as a last resort before contacting Engerywatch, I am willing to consider, as a reconciliatory gesture, making a one off payment, in full and final settlement, of £431.97, this being commensurate with my degree if culpability. I would then expect you to confirm that the debt is considered to be repaid in full.

 

 

I received a letter from them offering to accept £163 for a repayment plan!!!! I'm a single mother & there's no way on earth I can afford this.

 

Has anyone got any ideas for my next plan of action or can anyone give me the name of the chief exec/ MD so I can write directly to them.

 

Any help would be vey much appreciated.

Well who did you think supplied your energy? If you weren't paying a bill monthly/weekly.. you can hardly be surprised to be landed with an overwhelming bill!

 

However, their mistake at the beginning was cancelling your direct debit instruction.

 

 

That is just my opinion though.

 

Initially you WERE paying your bills until they messed around with your payment.
