Several years ago I ranup a debt on a Virgin Credit Card due to a failed business.

 

 

I agreed to pay the debt off at £60 per month (the debt was £15k)

 

 

They refused and took me to court and

 

 

they were awarded a charging order against my home.

 

 

I also agreed to pay £60 a month off, which the court agreed.

 

Fast forward several years and

 

 

 

 

My question is:

 

 

Does the charging order transfer with the debt to the new debtor?

go check land registry site and see if the name has been changed.

 

 

tell us more on the history please

 

 

did you ever SAR MBNA?

 

 

as 99% of those cards had PPI

 

 

and I bet you've heeps of PENALTY charges

to reclaim too?

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

can I claim PPI then, on that Virgin card?

Do you also mean that MBNA was the bank for Virgin?

 

What other penalty charges are there?

 

As for the history I ran up the credit card in 2009, when it went to court.

 

There were court costs, and the charging order.

Virgin agreed then to freeze the interest.

 

The debt was transferred to ME 111 in 2012

and is being handled by Optima on their behalf.

 

I have been paying £60 a month since 2009.

 

I also wrote to Optima in October 2013 for a copy of the original agreement, which they never sent.

 

I wrote to Optima last week explaining this and quoted the CCA and the how the 12 days had been exceeded by a year.

a CCJ trumps the need for a CCA

 

 

however if MEIII or optima WERE NOT THE NAMED CLAIMANT

on the CCJ/CO...then WHY are you paying them?

 

 

they would need to get their name substituted first on both.
