      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

yes, bong - been meaning to ask - does it mean just copy out that letter and attach to the n150/N149 along with it, anything else to do with it??

or is it the answer to one of the questions on the aq. you know me - that technical stuff gets me. why doesn't a mod move both those two threads next to each other - i spend half my time looking for this stuff.

 

Bex, good luck with the search, and unless debs has been demoted or promoted she certainly does deal with claims! little scamp, her!

I believe that the case will last no longer than one hour.

This issue is not a complicated one; it is an issue of fact and not of law. The issue is only whether the money levied by the Defendant in respect of its customer’s contractual breaches exceed their actual costs incurred. I am happy to pay their actual costs and I am surprised the Defendant did not counterclaim for these, because I would have paid them without argument.

 

However, the continuing problem is (in common with the 100s of other cases currently being brought by other bank customers) that the banks refuse to reveal the details of their penalty-charging regime. As the banks have a fiduciary duty towards their customers, they have a duty to deal straightforwardly and in utmost good faith.

 

Accordingly, I would respectfully ask that the attached draft direction be made into an order.

I believe this would bring a rapid end to this litigation.

 

If its an N150 AQ, at F tick yes and then no, and at H write the same text as above, but not the line about the case lasting for one hour as this has been answered elsewhere in the questionnaire.

 

You then attach the draft direction, making sure you have added your own case and court name and claim number etc.

Hi everybody, I am new to the site. I have received all my statements, totalled the amount and sent the first letter to HSBC by recorded delivery.

 

I received a reply a few days before the 14 day period, the letter informed me the matter was being 'investigated' and I would be contacted in due course.

 

As advised on the BBC website, I responded informing them I was willing to give them a further 14 days in which to resolve the matter before I registered my claim. A few days after this Colin Langdale sent a letter of reply saying all the usual "fees are clearly stated" and "you can complain to the Ombudsman" that everybody recieves.

 

In the letter he said that was HSBC's final response so does that mean I am able to begin my MCOL now or should I wait for the 14 days from the 2nd letter I sent?

 

Also I am unsure of how to calculate the interest? I am claiming £1437.50 and the date of first penalty was 7th March 2001

 

Sorry if it seems a stupid question but I have read how to calculate it and cant get my head around it.

pjb2007 - first welcome to the forum, next, let's get you your own thread. look at top or bottom of the list of posts on the forum and you'll see new thread tab, just press it. you'll have your own place where you can keep track of your things and you can ask questions you need answering and it is much, much easier to find you again - if you have your own thread.

it is to your benefit to come to grips with the charges you are asking back before you proceed to the LBA which should be your next letter - but first, have you used a spreadsheet to figure your interest? maybe i can help you understand the difference between the interests and how to work them on the spreadsheet by sending you this link. after you have read the faqs and step by steps on this site, you will be ready to make a list of your charges you want to reclaim look at post number 9 on this thread:HONEYGIE sees you HSBC! (multipage.gif1.

once you've done what it says - you will then have a schedule of charges (your spreadsheet including overdraft interest, if you want to reclaim it but not yet including the 8% interest that you can claim at the court filing stage.) Your spreadsheet is your schedule.

then you will be ready to go back to the library template letters and send an LBA and include the breakdown. I would consider you have already sent a prelim. approach letter and are now ready for the lba - but read up first and see if your list of charges is as you want it before you send it off with the lba. ok>

sign that offer - cross out the line about confidentiality and get it back pronto. i think the money should come in 7 days or so - but keep on top of them and don't halt the court action until you get it.

bex, i tried that link michael sent and got nothing - i find the mods this way (probably the equivalent of snail mail but it works). when you first come onto the forum - before you press for the banks, scroll to the very bottom, you'll find how many people are on line, etc. look for names in green, they are mods. click on one and tick send a pm to .....,

site helpers are in pink, and the gods are in red.
