      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

what you believe is enforceable and what IS should be 2 differing things check then each one , I will guess they are all PDL's?

 

the defaults you have will be killing your score

and regardless to paying a defaulted debt off, it does NOT improve your score nor remove the default.

 

as for running monthly markerson non defaulted debts, I very much doubt that's is having any effect upon you present credit worthiness or not.

 

so you do have existing/old defaults to run to 6yrs still showing at all?

 

if so I wouldn't rush to settle anything bar the utils debts. and are these still with BG or sold on.

you have time to do a deal with each lender....

the fact they might not have enforceable paperwork could knock £100's of a settlement

Im not sure what you mean by are they all PDL’s currently none of the debts are chasing me or sending letters. 

 

And are you saying that even if I settle the debts so no more new default are being added. That won’t improve my credit score? If it takes 6 years for a default to be removed isn’t it better to have no more added to it? 

 

Also how can I find out if the debts are  enforceable. Do I need to write to the credits to find out what paperwork they have?

I’m not sure who you mean by the OD and do you want me to see if the PDL is enforceable or not pay it at all?

 

And what should I do about the NatWest? Surly there’s a case getting it wiped if the charges came from them charging me for a PBA that I had told them to close and they said they had. Also am I paying the credit cards back in full or trying to get a reduced settlement?

Right okay so I should just pay the credit cards off and set up a repayment plan with British Gas. 

 

So what do I do with the NatWest and PDL? I’m assuming I’ll need to make a complaint with them to sort this all out.

Why them first? I’ve not heard anything from them for years and there not chasing me. I was thinking of paying them £90 a month so it says arrangement to pay on the report until it’s paid. Then If i pay of the credit cards I can get them back and get more points each month. Wouldn’t that be better for the credit rating.

Also I’ve just been looking at my bank and the default date for the British Gas is wrong. The last time I made a payment to them was the 03/04/2017 so the default should of happened on the 03/10/2017 not the 06/09/2018. Who do I need to complain to for this to be updated?

Well If I pay British Gas £90 a month they’ll be paid off in about 17 months. That’s a long time but if it’s gunna effect my credit rating until November 2023 why bother paying it off early? 

 

Ive worked out too the PDL default will be 6 years old on the 22/01/2020 so is there a point even doing anything with it? If it gets removed after 6 years does that mean I won’t have to pay it back?

default dropping off on its 6th birthday

which removes the account and any DCA 'duplicates' of the same account from your file

doesn't mean the debt is not necessarily still owed no.

 

you are slowly realising the idea now of my earlier initial comment and its wider implications 

'go have a holiday'.....

 

there might well be otherways...such as for example again of using an IRL complaint for the PDL one..to counter the effects on you these debts have a p'haps strengthen your bargaining pot to good effect for future credit.

 

but yes ofcourse you need to consider where prevention of further credot file damage maybe mitigated by settling some of the other 'happy to date' credit or debts on your file
