      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I have been trying to repair my credit over the past few years and still

 

 

there is one debt that I don't know what to do regarding wrong information being reported to the CCA.

 

I took out a loan back in 2006 with welcome finance and never paid it for some reason or another.

Young and stupid!!

 

The debt was marked as 6 payments late for years according to my credit report..

Surely this is wrong and it should have been defaulted within 6 months?

 

Account Type: Loan Started: 24/04/2006

Default Date: 13/06/2012

 

My last payment or contact with them or a debt collector I think was 01/09

I would have thought that it would be nearly statue barred.

 

I have recently looked up my credit report as I'm getting married

and would like to get a mortgage sometime in the near future..

 

The account is now being reported by another company called Intrum Justitia

and states that it was defaulted on the 26/05/2012.

 

Now can I do something about this as if it had been reported as defaulted back in 2009

It would be or nearly statue barred.

 

I have been reading on this site about sending letters and complaining

but I don't know who I should contact or even if I should though I would like this sorted.

I have put in a complaint to the CCA but I don't know what this will do.

I believe you can still have a default on your Profile yet it be Statute Barred...

I believe it is from the last payment which was made...

 

But the site team will need to tell you more.

@I think you are falling into the trap here with CRAs and Welcome in particular...

they were very bad t reporting this stuff. Lights mean nothing, its the account status...

Welcome defaulted a lot of there accounts well past their time they should have been but due to the ICO there is nothing you can do about that.

Are you sure that it is the default date that is recorded and not just an update of when the new owner of the account took it over?

 

I would be inclined to SAR Welcome to find out what the actuality ids on the account.

 

Statute barring has no effect on what is recorded on a credit file, the two are not linked.

 

You do need to find out what has happened with regard to the actual default date and what appears on your credit file though.

You do need to find out what has happened with regard to the actual default date and what appears on your credit file though.

It looks like you have fallen foul of Welcomes policy of defaulting delinquent accounts immediately prior to selling them off, having kept the account "live" by using late/missed payment markers.

 

This problem has been addressed in the past by making a formal complaint to Welcome

querying the late and unfair default .

 

Although the ICOs view of this has changed somewhat in regard to this situation

it should be possible to get the default date reset to the approximate date of the last payment

and/unequivocal written acknowledgment of the debt.
