Thanks for the explanation. I kept calling the witness statement a defence out of a bad habit.

 

The case summary isn't something I need to do, it's not in the directions. Or is that for different more complex situations?

Today was the last day I had to submit my witness statements.

 

I had delivered them.

 

I must admit, MKDP are a sly bunch. They're office is names the Conpello group and they act quite suspicious!

 

Anyway, I've had nothing from them at all, but I had to submit today to comply with the directions.

So I've recieved a special delivery.

 

They're witness statement refers to two accounts now. Which is what is not in the particulars.

 

There is two credit agreements one for the credit card and the other for a current account.

 

There are statements.

 

It states on their witness statement they filed a claim at a different address to what I live at....they're out of the directions time.

The default notices are generic and are not relative to me.

 

I need to go through this all carefully and figure out a plan.

 

Any help of suggestions would be great.

Great news!

Claim dismissed!

The judge spotted all the inaccuracies and even that the documents MKDP provided didn't match their claim.

 

Can't thank you enough Andy and Oleg!

 

I would like to make a donation and be of assistance in any way on this forum. I feel like I owe it! Excuse the pun! Haha

They did indeed send a solicitor.

 

The documents they supplied were shocking. Put it this way, we all were confused at the 3 different account numbers mentioned throughout the documents.....

 

The Judge made the remark that MKDP need to sort out their house before submitting these claims....

Not sure whether you're recovered yet but, when you are, could you kindly answer my *exact* question from earlier. I am keen to know whether they sent their IN-HOUSE solicitor.

My apologies Oleg. In my excitement I wasn't very clear on answering your question.

 

The Solicitor was definitely not their in house solicitor. She stated she was instructed that morning and given the paper work only an hour before. She was very nice to me. So I think she definitely was not a MKDP breed! 😁
