      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

 

Received my Lloyds account details today

 

 

one thing that stands out is on a covering letter is

"Copies of Default,

Enforcement,

Termination and

Assignment notices

are not saved by customer names so we are unable to provide copies under the Data Subject Access Request"

 

 

does this mean game over for DW?

DW have yet to supply any of my requested information.

Hi DX,

 

 

Just checked my credit file with Experian and

 

 

don't have any default showing for the loan Lowell's are chasing,

 

 

have still not received anything from DW about my CPR request and

 

 

no default in my SAR from Lloyds.

 

 

Do you think this will go all the way to court?

Hi,

 

Had a call from the court meditation team two weeks ago

 

 

asking me for dates for meditation so

 

 

have an appointment book for this week

 

 

Have not received anything from BW with regards to my CPR or CCA request.

 

 

Not sure what I should say....?

 

 

Any advise would be appreciated.

You state what you said above...you have attempted to clarify the claim they have failed to respond...so very difficult to mediate.

Andy thanks for your help, nice lady called me first and went over what was going to happen and I told her that BW have not sent me required Docs she then said well there's no point in mediation until BW produce the Docs you have requested and then you will have the option of meditation. She also said that she would not enter mediation unless she had all the information in front of her. So she then went off to tell BW no docs no mediation.

 

Next step just wait and see...?

Update,

 

Notice of allocation to the small claims dated 13th Oct received on the 18th. I have sent an email tonight saying I'm happy to enter into meditation again!! and court date set for the 8th Dec. Claimant must pay £335 today. Still no CPR or CCA do you guys think they will pay? if they don't what will happen?

Hi,

 

received a letter today from BW legal and

 

in it was a Lowell witness statement and

 

this contained a letter from Lowell saying they have bought the debt

 

an Introduction letter from Lowell,

 

copy on the Lloyds loan agreement + T&C's,

DD agreement and

a load protection acknowledgement

all signed by me with date.

 

Along with the info was screen shots of the account showing all payments and transactions

 

with the final transaction on the 22/01/2009 showing the debt being written off

 

I have checked again my credit file and the default is dated 24/7/2009, the default with that date is not on there.

 

Still have not any received any response from BW with regards to my CPR or CCA Request

 

unless the attached doc's mean they have???

 

 

very confused now.

Hi DX,

 

I have just gone through the transactions sheet that was attached with Lowell witness statement

and it does not show a default on it

 

 

only a write off as a comment on the final transaction on 22/1/2009.

 

 

I have no default on my Experian credit file and have not received a default form LLoyds

 

 

so how can i find out the alleged default date?

 

 

if the default is from the write off date then in January it would be unenforceable.

 

 

I have a court date of 8th Dec.

you should have a comms or account log in the LLoyds SAR return?

 

 

there must be mention of one being sent in there

that's all they have to prove 'one was sent' .
