    • In my experience (not with car payments) but with many other things, my partner has been ill and signed off in the past and we have been unable to meet various commitments.  Naturally if you ring the call centre they are going to fob you off and tell you you must pay, that's why that never ever works. I would obtain a note from her GP listing all her health issues plus medications plus side effects, then write to the finance company with a copy of it, explaining the situation, as you have here, asking for a payment holiday. Perhaps mention that the car is very much needed for hospital appointments etc. It's likely the finance company would rather you pay till term end than, chase you for money they will never see, and sell the car at auction for a loss,  You can search some of my threads going back years, advising people to do this for Council Tax, Tax Credits, HMRC, Even a solicitors company and it always works, because contrary to popular belief people are reasonable.
    • Sorry, I haven't ever seen one of these agreements. Read it all and look out for anything that says when she can withdraw and when she is committed to go ahead. If it isn't clear she may need to call the housing provider and simply say what you posted here, she doesn't want to go ahead and how does she withdraw her swap application?

Your head is like a power bank of knowledge.  Her health issues are short term, due to a relationship breakdown she took it pretty hard and has been signed off work on medication for 3 months. She only started her job in February 24 so does not qualify for any occupational sick benefits, which is where the ssp only comes in. (You will see me posting a few things over the coming days, whilst I try and sort some things for her)  I sat with her last night relaying all this back and she does want to work out a plan, she was ready to propose £100 for the next 3 months and then an additional £70 per month onto of her contractual to "catch up" but Money247 rejecting the payment holiday and demanding £200 thew her, which is why I came on here.   
    • I've looked at your case specifically more.   Term 8bii reads " when, in accordance with instructions from the Customer or the Consignee, the Consignment is left in a safe place" Their terms choose to not define safe, so they are put to proof that the location is safe. If your property opens onto a street its a simple thing of putting a google earth image and pointing out that its not a safe place

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All,

 

I was wondering if you could provide some advice please.

 

We took a mortgage out on our current property with Mortgage Express back in 2003.

 

From then until 2009 we made EVERY payment ontime, every single month.

 

in September 2009 we hit some financial difficulty and

 

I phoned them to see if I could request a 1 month holiday payment.

 

I was advised yes I could and it would be added onto the end of the mortgage

and a need to reschedule payments would not be needed. Superb.

 

No need to cancel the Direct Debit, nothing at all.

 

About a year after that we started to receive phone calls and letters telling us we were in arrears.

 

I explained the situation and

they denied all knowledge of what I had been advised.

 

They knew Id asked over it, yet did not agree they had said anything of the sort.

I asked them to produce a copy of the phone call that took place, however they "cannot find it"

 

- Roll on until 3 months ago, the odd phone call here and there, me explaining the situation, them denying it.

 

3 Months ago,

 

I phoned them and advised that I was sick of letters and phone calls

I will agree to start to repay them.

I went through a financial breakdown with them, (which with 5 kids is near on impossible)

as i offered 50 pounds per month on TOP of my mortgage to reduce my arrears.

 

They said that I couldn't rely afford that, as my outgoings were more than incomings,

(they never are - however when someone asks you how much you spend on kids shoes per year - what do you say).

 

I argued with them and told them I could afford that.

They told me then could I cut costs in other places and get back to them.

To be fair we havent heard anything since today....

 

In all the time we have and still are continuing to pay the monthly amount on time.

 

tonight I come home to 2 crappy typed up letters,

one addressed to the "Tenant" and

one to the "Occupiers"

 

telling me that Proceedings to Re-Possess our house have commenced, and I am due in my local court at the end of May.

 

Can someone please advise me here on where I stand.

 

Does this need to go to court?,

 

Can it go to court?

- If I have offered payments to reduce arrears and argued the toss with them,

how can this be the next stage.

 

We simply dont want to lose our house and we are absolutley petrified with rage.

 

Any advice, comments, tips would be MORE than appreciated.

what statements have you been getting.

 

have they been charging you arrears fees etc etc

 

can you scan up the letters too please

**you can post up images/letters by this method immediately..you don't need 10 posts**

.

set your default scan page size to A4 less than 300DPI [150 will do]

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

ENSURE: remove all pers info inc. barcodes etc

but leave all monetary figures and dates.

Hi Dx,

 

Yes we were getting charged arrears fees, (cant remember exact figure)

 

which I always told them I would try to claim back once settled.

 

We only received 1 statement a year from them. We are due one around now.

 

So I cannot scan anything at the moment (all others have been misplaced).

 

Definitley been charged arrears.

Hi Dx

 

Apologies for not being back on

- had some pressing family issues to deal with.

 

i phoned them after reducing my payments to an unsecured creditor and offered them the difference,

they blatantly refused again and

 

the person on the phone (who i have put a complaint in over) said

"you dont have a leg to stand on, im taking this no further - good evening"

and slammed the phone down.

 

After i had calmed down I then rang again the next day and

spoke to another person, who again went through my outgoings.

- They told me i still had more going out than in, even with the creditor difference.

 

I then questioned my incomings details they had.

COMPLETLEY WRONG.

 

Yet they still refused and said see you in court.

 

I then had a friend in finance type a letter up and i faxed and emailed them,

threatening to report their conduct to the fsa and fca, f

 

ollowed by another call - another manager then ok'd my offer.

 

I said Ok, ill just tell the wife and we can arrange that.

This was a £150 payment a month on top of my mortgage.

 

Spoke to the wife - she was so releived as I was.

 

Phoned back ANOTHER called looked at the form of incomings and outgoings

and told me it was impossible for me to pay it!!!!!

 

Again I questioned the forms incomings.

 

STILL WRONG.

 

- Re did the form for incomings and outgoings again

- this time i had a lower disposable income but they accepted £80!!!!

 

So now hearing cancelled, letter from solicitors confirming that and new payment of only 80 quid more. RESULT.

 

This company though, are bandits.

 

The scare tactics and hounding are incredulous.

 

Only that letter and me continually questioning this has resolved this.

 

Thanks for the initial advice and people be warned,

 

Mortgage Express are a proper set of bandits.

 

Anything to make a quick buck by reposessing your home and selling it on.

I agree with dx. Send off that SAR and keep off the phone! If they ring just tell them you'll only deal with them in writing and put the phone down.

 

If you think you may be in arrears and can afford it you could start paying a bit extra off, which would make it difficult for them to take you to court, but as dx says, they probably owe you.

Hi

 

Well, the saga continues. - I ended up paying the month holiday payment back at £50 per month which is now clear. Got a statement today, and we owe 580.00 in fees and arrears.

 

I have questioned them on the phone and they have said that we have had field agents etc - (we havent) and no letters to say we have. Letters, phone calls all been charged this year too. Had none as we had a payment arrangement in place....

 

However the most shocking thing in all this is, that after all the payments etc our balance has been reduced by virtually nothing.

 

Is it a case of SAR time. as we have been murdered on interest.

Ok thanks. As for the SAR, yes I know and we were starting the process, unfortunatley, new jobs, deaths in the family all came as priorities.

 

I have questioned the field visits and have asked for proof of visits etc to start.

you don't need to question them

they are unlawful as all the penalty charges are

 

 

letter/phone/visit/late/it raining

reclaim them all

and any stupid insurances they made you take out too.
