    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello. I am planning on going to brighthouse on monday anyway

but just wondering if anyone on here knows the most likely outcome..

 

I have been a customer for a while and never had any problems. T

 

he prices I am paying seem quite reasonable to me and if I have had slight problems (sofa came apart a bit)

t was sorted pretty much immediately, so glowing report from me so far..which seems to be rare :p

 

I have a feeling this is going to change though.

 

I have a samsung galaxy s4 from them which I have been paying for for around 8 months or so now.

 

Never missed a payment or anything.

 

I (like many others) was told when getting it that DLC and OSC were essential..

but I dont really have a problem with that despite finding out that they arent.

 

..my problem is.

 

.today I have lost my phone.

 

Well, I'm not totally sure if I have lost it or it was stolen from my bag

but it was there this morning and it was not there this afternoon when I got home.

 

Does the DLC cover this?

 

If it does, will I get a replacement/refund/what?

 

I have been reading about various DLC claims

and it seems brighthouse are quite unwilling to pay out on the insurance that they force on people :/

as for there prices being reasonable...you sure..

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hmm. Not too sure what to do now then as I am not totally sure I have lost it as I said earlier, and if theft is covered its quite tempting to take the chance that it was actually stolen as I dont know either way :/

 

Do you know if they keep track of IMEI numbers? Just so wherever it is, it can get blocked..even if I do have to keep paying for it, I dont want someone else getting my phone for free, regardless of if they found it or stole it

 

Yeah prices dont seem too bad tbh. Mind I tend to only buy things when they are on 'managers special'. My sofa costs only £4 per week and about £500 overall(inc interest and stuff) and its in seriously good condition.

Thought they might. Mind when I lost my purse a few years back I told the police I didnt know if it was lost/stolen (not sure how people 'know' they have been pickpocketed or something really anyway, could easily be loss) and they gave me a crime number and put it down as theft anyway.

Besides the fact it's lost or stolen, if you were told OSC was COMPULSORY, this is mis-selling at it's finest. It's Optional ... I'm currently taking Brighthouse to Court to reclaim unlawful charges, DLC and OSC as the full facts are never explained, plus there is nothing in law to say items must be insured. Hopefully I'll get a result and will open the door to clamp down on these daylight robbers.

I would just like to clarify that the DLC (Damage Liability Cover) covers Fire, Theft and Accidental Damage only.

Went in yesterday (with crime number) and explained..didnt feel right saying it had been stolen when I'm not sure if it was stolen or lost so told the truth and the lady understood that its hard to know if something like a mobile is stolen or lost. Decision is apparently in the hands of the store manager now?

 

Apparently they dont keep track of IMEI numbers, which wasnt good news. I know I should have had it myself..but its going to really annoy me if I have to continue to pay for this phone when whoever has it now can use it. Would much rather I could get it blocked :/

did you get this problem sorted out?

 

you say you have been a customer for a while, perhaps it would be better for you financially if you were to reclaim the insurance money you have paid to them for ALL products you have purchased from them

If I've given you advice, then it is just my thoughts / opinions - doesn't mean I am right!
