    • Interesting question regarding what Government accounts opposition parties have access to, before an General Election. From what I understand, Government department accounts that are published are always lagging behind and would not include some amounts which are classified as 'commercially sensitive'.  Therefore opposition parties and Parliamentrary select committees would not have access to accounts which contain real time up to date information. If a new Government have found £20 billion of spending liabilities they did not know about, this could be true, as £20 billion is not that much when you look at total Government expenditure. Government department are making decisions on spending all of the time and it could be the previous Government were planning tax changes and/or spending cuts to balance the books.  Jeremy Hunt has recently said that if the Tories had stayed in Government and held an Autumn budget, it would have been very difficult to cut taxes as some had wanted.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have recently been trying to make a claim on my warranty cover for my BMW 1 series with the WMS Group.

 

I purchased the 4 star policy when I purchased the vehicle.

 

This is the first claim I have tried to make in three years.

 

This claim was for the Steering Column, because the warning light on the vehicle was showing RED.

 

They told me NOT to take it to a BMW Dealership but to another garage to have the repair estimated.

 

The repair, according to the garage is for the sensor light on the steering column, of which,

WMS SAY is NOT Covered on the policy even though the steering column is.

 

Having now read the policy from back to front, it is virtually impossible to make a claim on this warranty for anything,

even though this was not stated when the policy was taken out.

 

The policy states Steering, of which this should fall under. The policy is worthless and no one should ever purchase this in any form.

 

I need advice on how this can be classed as a miss sold policy so I therefore may be able to at least claim the cost of the policy back.

 

I feel they have left me with an un-roadworthy vehicle and the cost of repair is £600

 

If anyone else has had similar problems I suggest we get together and close these businesses down as they are doing more harm than good.

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

How can we get together and stop this sort of legislation been sold to the consumer?

We know it's a farce but when you see that it is covered, then they say it is not because it is a component of the part thats covered, surely thats wrong?

 

We need action.

Two faults, an air sensor and a hydraulic tailgate fault on a Porsche Cayenne - no interest and surprise, surprise, not covered...not really sure what is covered. I had previously read a lot of lousy reviews on this particular warranty company, excluding the fake ones they pay to have posted on their own site, and should have guessed that they were one of the worse ones. Lesson learned, but like most warranties, they are not really worth the paper they are written on but I would always avoid a WMSGroup warranty in the future.

Just dealt with WMS group re my warranty myself. They were aggressive and hostile about the entire process. They insisted that a part that I have been advised by two garages that cannot be fixed can be fixed and blamed the garage for the fact that they will not cover the cost. DO NOT a warranty with these people.
