      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have given my goods back to Brighthouse, due to me not having the money to spend on it,

but now im in a safe financial state, I would like to ask if I can have my goods back.

 

Im not sure sure if they have sold it on, or they kept it.

 

Its obviously to late to ring and ask.

 

So wondering if someone on here could shed some light on what they have done with the goods.

If you returned them and the contract ended, then theyre gone. You'll have to retake them. However, i would SERIOUSLY advise against doing that. Especially when the same items can be found elsewhere for less than half the price.

Erm. No I never got any paperwork when I handed the goods back.

 

I dont believe im paying for them as I havent paid anything since it went back which has been about a month now.

 

I have a TV out with them which Im still paying, well sort of.

 

Ive got into some financial difficulty, but im back on track and they have been to my door and took my last 11.50 off me for my tv payment.

 

But said I still owe money (which I know I do) .

 

.. The BH woman walked off into her van, and they have been trying to contact me to get my account up 2 date with my TV.

 

But I wouldnt mind havin the goods back I returned (i didnt recieve any paper work, I just signed a letter to say I handed it back, which she kept)

they are not bailiffs and you should never hand over money at your door to anyone!!

 

as for the goods they have I believe 1 month is ok

 

you just ask for them to be returned.

 

how far are you in to the deal

 

might be an idea to cancel?

 

you'll have been paying OPTIONAL OSC and DLC insurance?

 

you do realise you can reclaim these and now p'haps owe them nothing?

Im going down to my local BH store tomorrow to pay em what I owe so far with my TV. I will defo ask for my other item back, but will they give me it straight back or will they want to see I have financial safety again? Because I dont have any proof like wage slips at the moment.

 

The payment I made on my doorstep was through bank card.

 

It was 2 weeks ago when I gave them the item back, but still have the TV. I have had OSC on the TV out since I got it and am nearly finished paying for it. I have never had any problems with it and never used the OSC so could I claim that back, and what about all the late fees ive had, there is like over £100 in late fees, would there be a way to claim that back?

We always seek to work with customers who have missed payments to help them find a way of getting them back on track. This includes offering to downgrade the item to a less expensive model or returning the item for a short period of time whilst freezing payments.

 

If your goods were handed back on a 'Pick Up And Hold' basis then we can look to return these goods to you. The store will want to see that you are in a position to re-activate the agreement before allowing you to take on the additional credit.

How can I go about reclaiming what i can?

 

Ive spoken to the store today and they have said the item, was sent back (whatever that means). So they no longer have it.

If you dont have all statements then youll need to sar brighthouse. You can reclaim all insurances and charges at the interest rate they charged you. This will pretty much clear any debt with them. If I were you id go somewhere else.

 

With bh you are paying 4-5 times what every other company charges.

Can i reclaim any fees and late payments including the extra protection thing i took out on my TV? and any late payments from the TV. Im still paying the TV off (i still have it) and im not to far from finishing it.

Of course you can. You can reclaim all insurances that were missold, and any unlawful charges on the account. Thats why you need those full statements.

Just an update.. Ive had a letter back from BH and they have said they will not and can not refund me any money for any late fees or OSC even tho I have not used the cover. The TV is still out and I have 19 weeks left to pay.

 

Is this right?

Ive just had Bright house at my door trying to get in to get my TV.

 

They are demanding money and requested I pay them something right now on my door step!

 

I was tempted to shut the door in there face.

 

To be fair I have missed 4 weeks payments.

 

But still demanding money on my door step!

 

I wanna take this further, but I dont think I can with me owning them money.
