Hi,

I have been reading through all the relevant threads and don't know where to start!

 

My son received a PE charge a couple of months ago for parking in a free retail car park for 25 minutes longer than he should.

 

On researching, I found that most advice seemed to be to ignore everything (now seems that may not have been the case!) so

 

I advised him to do this, which he did, and now has received a county court claim for £165!!

 

I am now feeling guilty for advising him to ignore the initial charge,

 

am wanting to help as much as possible to fight this unfair situation.

 

Hoping that you can help?

 

I am just completing the Acknowledgement of service,

as this appears to definitely be the route to start,

but will not send it until I have hopefully heard from someone.

In case it helps us to advise you, please would you type up the particulars of claim [POCs] minus any identifying information? And what is the date of issue on the top right of the form?

Hi, thanks for the replies, and you have already made me feel more confident in fighting these money grabbing barstewards!

The issue date is 24/3.

The particulars are: "claim for monies outstanding from the registered keeper, in relation to a parking charge, issued ......., for parking on private land in breach of the terms and conditions (the contract). PE's automated number plate recognition system, monitoring ............. captured vehicle .......entering and leaving the car park overstaying the max stay time. The signage, clearly displayed at the entrance and throughout the car park, states that this is private land, is managed by PE Ltd, and is a max stay site, along with other T & C's, by which those who park on site agree to be bound. In accordance with the T & C's set out in the signage, the parking charge became payable. Notice under the Protection of Freedoms Act 2012 has been given under Sch. 4, making the keeper liable. This claim is in reference to Parking Charge .............."
