      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Chezt, they cannot locate the original agreement so they have no mandate to process your data. They will realise that. And if they are going to be difficult about removing the default, better that you know now, when you still have a second bite at the cherry as it were.

So the N266 Notice is nothing to worry about then ... It's issued from the court by the looks of it so may be required to complete it!

Just spoke to a very nice lady at the courts who said she thought I shouls complete & return the N266 form along with the rest of the documents to be with the other party & the court by Friday 9th March ... I explained that we are probably nearing settlement & she agreed this was probably just a 'time waster' thrown in' at the last minute also.

 

I'm gonna finish preparing the court bundle just in case I need it but aren't gonna print anything untill the last minute just incase I don't need it ... paper n ink costs me a lot of money! :-x

Forgot to mention .. I'll also need some help adding into my bundle about the non-compliance for the CCA request ... Do I add this into my statement of evidence or do I just include copies of the correspondence I've had on the matter so far??

 

(Feel like I oughta keep 'em in my back pocket & pull 'em out & announce 'Taadaaaa' *like magician pulling rabbit from hat* 'what do ya make of this then u bunch of crims! (Well they have now committed an offence haven't they!) 'Take 'em away .. lock 'em up n throw away the keys ..... give me my money back first tho!')

 

OK it's late, my eyes are tired n I'm drained with all this bundle stuff .... That's my excuse for the 'crazed' post anyway! :p

 

EDIT: Do you think I may be as well sending another letter to LW clearly pointing out that they have committed a criminal offence & that I will be mentioning this in my forthcoming court action against them? (Damn should I have mentioned this in my last correspondence to their solicitor? Actually I think it's in-house anyway so they shoulda *hopefully* have seen a copy of my last letter - praps that's what sparked the offer?? Sorry I'm thinking in type! :p )

Time is on your side or more corectly, it's running out for them.

 

Tryna relax but if they don't reply or refuse then I've gotta submit my bundle for Friday which means I oughta post it Weds/Thurs so wanna be prepared in case IYKWIM :|

Right then peeps .. I need help .... I'm completing my court bundle & have the following Q's

 

  1. I've used Bookies court bundle & the first problem I have is I can't change the first page to update the documents/page no's etc?
  2. I presume I'm ok to leave in everything except the early day motion?
  3. I need some help adding into my statement of evidence about the CCA Request non-compliance - how should I word this. I presume I then add the communcation and the incorrect contract as supporting documents?
  4. In the statement of evidence I've changed the word bank to Littlewoods or defendant where appropriate but I think some of the stuff in there I will have to delete fully as it's not relevant to my claim (eg 1. Nicole Rich, “Unfair fees report 2. The american study re bounced cqs 3. the BBC2 Money programme documentary 4. The statement following the BBC2 Programme bit referring to automated letters 5. Peter McNamara interview)

Also in the court bundle it says just to print the relevant case law stuff but I'm puzzled as to some of it appears to be missing & there is just a row of dots - ie -

'Part III

Supplementary

17 Minor and consequential amendments

(1)–(3) . . . '

Is there a reason for this - not that I don't trust I just like to understand!

1) I assume you downloaded the .zip file? Go to that page, highlight the text, copy and paste in new Word doc, save as... (new name), you should be able to change things then. It might be that when you d/loaded, it got saved as a read-only file, so that will allow you to do it. I hope you don't lose any of the formatting, but if you do, no biggie, I have every confidence that you can reformat it yourself. ;-)

4) Not sure. I would have thought that BBC programme about automated letters is very relevant indeed. The principle is after all the same.

 

5) There should be nothing missing, the formatting screwed up and I need to get back in there (also to update OFT link), but the main file is on lappy which is away for repairs, so can't do it straight away. Can you tell me from which document this comes? (Surprisingly enough, I do NOT know the UTCCR or UCTA by heart - yet - :rolleyes:) and I'll double-check.

Oh just thought of summat else (I knew I would!) Should I add to statement of evidence a reference (backed up with correspondence) regarding the debt being chased by the DCA & being defaulted?

 

I've just thought also about needing to add in the bit about now wanting the default removed & the reasons etc (more or less as in my last letter to the solicitor) but do I need any other reference?

 

Also - silly Q but is there any sorta order you should put things in your SoE?

Bookie - I did have to fiddle with it a bit & I've sorta condensed it to fit on less pages IYKWIM? (I haven't deleted anything tho except the EDM) I'll e-mail you what I now have for you to have a look .... the bit I posted above is on my page 28 near the bottom but there are more of these too! As I say I'll send it over.

Well nowt in the post today so I'm doomed to print & send the court bundle! So I'm ready to finish apart from the few outstanding Q's above. (If I can't get them answered I think I'll just have to 'wing it' - not ideal but ......!)

 

I've got a full ream of paper & a spare ink cartridge at the ready to print off all this tonight ready to post 2moro - Looks like it's gonna be a late one for me - printing & numbering!
