    • Write to the IPC complaining that UKPC have not observed the requirements of PoFA . IPC  Waterside House, Macclesfield SK10 9NR Dear IPC, I am writing to complain about a serious breach of the Protection of Freedoms Act 2012 by UKPCM. I feel that as it is more a breach of the Act rather than not just  complying with your Code of Practice which is why I am bypassing your operator. Should you decide to insist that I first complain to your operator, I will instead pass over my complaint to the ICO and the DVLA . My story starts with being issued a windscreen PCN on 8/3/24 which was almost immediately removed and a second  PCN was then  sent by post on 13/3/24  [deemed delivered 15/3/24] which I did not receive and had to send an sar to have that particular mess revealed later  but that is not the reason for my complaint. UKPC then sent a Keeper Liability Notice dated 12/4/24 warning me that as 28 days have now elapsed, I as keeper am now liable for the charge.  This is in direct contravention of PoFA since the keeper does not become liable to pay until the day after the original PCN is deemed to have been given which would have been 13/4/24 -a Saturday ]. Not only does it not comply with PoFA but it fails to adhere to your Code of Practice and is in breach of their agreement with the DVLA. You will be aware that this is not the first time that UKPC have fallen foul of the DVLA and presumably yourselves. I have included copies of both Notices for information. You will realise the seriousness of this situation if this is standard practice from the UKPC to all motorists or just those where windscreen tickets are involved since the Law regarding PoFA is being abused and is unfair to misguide motorists. I await your  response which I understand will usually be within a week. -------------------------------------------------------------------------------------------------------------------------------------------------------I would think that should be sufficient for the IPC to cancel your PCN though  you should await comments from the Site team before sending your complaint. Don't forget to include both PCNs.  
    • Hi DX, Sorry, fell asleep as I was up all night last night writing that statement. Yes, I attached the rest of the witness statement on post 50, bottom of webpage 2. That's the important part.  It looks like the lawyer who wrote Erudio's Witness statement does not work for them any more. So, I'll have another lawyer representing instead. Not sure if I can use Andy's hearsay argument verbally if that happens.... I did not put it in writing. Apart from not sending deferral forms, my main argument is that in 2014 Erudio fixed some arrears mistake that SLC made and then in 2018 they did the same mistake, sent me confusing letters. What is the legal defence when they send you confusing material?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi there – I have a question re Defaults. I have a Default put on my Capital One card as I have missed some payments in 2011. Until then I have been paying regularly and at times twice a month to keep the payments up to-date. Then why have I got this Default when I have been making regular payments? Is this legal? As per below I have missed payments in May/June and then August. Since then regular payments of £10.00 every month was paid.

Payments made -Feb/April/July/Sep/Oct/Nov/Dec.

Hello just a quick reply: Yes this reporting is correct, if there are late or missed payments even if these are 'made up' a later date the creditor will have in the Ts & Cs a section showing why and when a they consider a default has occurred.

 

Reduced payments levels agreed or not are technically a default on the original contractually required payment levels.

Oh Ok thank you. I am waiting for the Statements and all other documents to arrive from Capital One. As soon as I get these I will know if I have overpaid the account. If the account is paid off then will this still remain ad D or will it be shown as Satisfied?

Hi there - having received all SAR docs from Capital One - the Default notice is unlawful as I never received the DN in the first place, and secondly one of the statements did not include my payment of £50.oo that along with the charges incurred led to going over the limit. So taken all these into account do you think I can get them to remove this as it is not lawfully enforced. thanks

There is nothing to stop Cap 1 issuing a new DN, and the alleged £50-00 missing payment from a statement is not a reason for removing the default.

 

A default notice is totally different to the actual default on the account.

Thanks - but the Default note should not be on my CR file because I have not exceeded 8 or more. Only 2 months and the balance is also wrong. So in actual fact the account is in dispute when they put the default note. Does this not make it unlawful to put a DN when there is a dispute on the account?

Exceeded what? 8 or more missed / late payments?

 

Creditors can and will default on as few a 3 missed payments there is no number fixed in legislation or guidance.

Thanks - My understanding is that after 8 late payments the creditors can put your account into default. However, in my case, if the missing £50 had been entered correctly the account would have been up to-date. Also now I know the account was up to-date and I am in credit so they had not put the correct information.

Have you advised the lender of any dispute at all either recently or at the time? If not then they don't know of any dispute.

 

Have you started off the process of finding out what happened to that £50 payment which has not appeared on the account?

 

To stand a chance of getting the default removed you would need to show that the account was operated correctly at the time. That would mean getting this £50 payment traced and applied to the account properly. If that has the impact of putting the account into a properly managed state and then you successfully reclaim any resultant penalty charges then you stand a chance of getting the default removed as part of the deal.

 

Having said that, you have indicated that you had missed some payments so that could make it more difficult.

Thanks ims21 - when I did receive all my statements after a SAR request - I went through all the documents and when I realised the discrepancies I wrote to them and waiting to hear from them. So my PPI offer is also on hold at the moment as I need to sort out the discrepancies first and then will accept the offer subject to they send me the cheque to me. Trying to get all sorted step by step. I thought if I get the account sorted and then ask them to get the default sorted and then will ask them to send the PPI refund.

sorry - yes I missed the payments two months but I always paid 3 times more to make it up and to bring it up to-date.

 

That I'm afraid makes no difference at all the cumulative effect of late or missed payments will usually result in a default the figure of

8 is irrelevant the creditor will have their own system for deciding when a default is placed.

 

If the amount of £50 was received after the date a payment was due it results in an LPM when 'extra payments' are received to remedy previous late or missed payments they are not allocated to the months in which the LP or MPs occurred.

Thanks - my problem was I was paying by Direct Debit and debit card, and never had a look at my statements until now. Now I am learning to take control of everything, and noted the ones that I have over paid etc. Since PPI and going on this site I have learnt so much. Thanks to you all. Still learning and its a long way from getting things right. I will work through the cards and PPI and get back to you soon. I am very busy with work etc and cannot find the time sort out my finance. Getting there slowly.
