HBOS SAR Signiature unable to Verify your signiature - CC debt sold to lowells

Hi,

 

I have spent a fair while searching the forums for this, but cannot find a similar problem, so here goes..

 

I am being chased by Lowells for a cc debt with HBOS unpaid from 2009, it seems to have just been taken over. I recently sent a SAR to HBOS with my signiature on the anti tamper signature image I found on here.

 

I have finally have[ATTACH=CONFIG]45409[/ATTACH] a reply acknowledging my request and the fee, but within the letter it states 'Unfortunately we are unable to verify your signature' and that I need to call them, which of course I have no intention of doing so.

 

My SAR and the reply are attached, with all the personal information removed.

 

How can I reply to this, and does this then constitute being in dispute?

There is no valid reason for NOT signing a SAR, would you be happy to supply personal details of an individual if the persons signature was not identifiable, or perhaps the bank just taking a chance you are the data subject concerned could lead to YOUR personal data getting into the hands of someone else.

 

Just sign clearly and return the request.

they've sold the debt

 

so theres nowt they can do to you anymore

 

fire lowlife off a cca request too

 

make sure they have a cca

 

else no money mate...go away.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Brig, gonnaliveonaboat, DID sign his SAR, over a tamper proof signature strip.

 

They are saying they cannot verify the signature, presumably because he has never provided one for them to compare against or over time his signature has changed.

 

gonnaliveonaboat, you will more than likely just be asked some security questions.. However, you can suggest they provide the SAR to a local branch, at which you will provide evidence of who you are.. eg, passport or driving licence.

 

If, however, they have been in contact with you recently, then they have no reason to mess you around. This is sadly a stalling tactic used by HBoS :(

Hi,

 

Just a belated update, apologies for delay, i have been ill. I got Halifax to send the SAR to a local branch!

 

I also CCA'd Lowells who had to ask HBOS for the document, who surprise, surprise could not find it due to time lapse issues. Lowells said they would do nothing unless HBOS eventually came up with the CCA.

 

Yesterday I got a letter from Lowells saying for commercial reasons and as an act of good will they have written off the debt and I will not hear from them again!
