      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I don't know if you have tried these people but maybe you need to speak to them or an organisation like them. With the greatest respect, if you feel suicidal and want to harm people, I think, you need to talk to someone. Is your G.P. Of any use?

well, my MP wrote again to the "appropriate" minister when I asked back in march why I hadn't had a reply yet. She got nothing either. Turns out that this appropriate minister states they replied to my MP by email...which she never received???? she then asked for it in letter format which she then copied and sent to me, all a load of gumphhh, waste of ink, and dodging the real points, no surprise there. my MP has now written with regard to the "missing email"....I am left wondering what the hell they are doing if they cant send a simple reply to a simple question, and make sure it gets there? and where the hell did the email go with my personal reply?.....beggars belief. complete waste of time.

I've done a lot of community work, over sometime, that's caused me to come into contact with local councilors and M.P.'s . I have found them to be a bunch of self-serving, waste of space, S***s.

Imagine how far a minister is removed from the likes of us!

A complete waste of time? Maybe.

There may be charitable organisations out there that can give you the help you need.

Thanks for your reply pitcher, i don't want to harm anyone as such what i mean is if iam put in the situation where i cant control my emotions i know i could harm someone that's why i keep myself away from people that i dont know and even the people i do know. I tend not to go out very often i feel as though i have some sort of social phobia if that's possible.

 

My doctor is useless honestly i had to try and try for him to give me the unfit for work note and even then he didn't put on the correct information so my money got stopped. The other doctors are just the same they see that many people they seem disinterested in what people have to say. I think iam going to have to get in touch with The Welfare Rights people to see if they can help.

If your G.P. Is a waste of space, then just use Yellow pages or Thompson’s to find a new one, in your area , it only takes a phone call. I have a “group practice”, I've got one doctor who is a total %$**& and one who is just what you need from a G.P.

I use the good one. You can do the same thing, I urge you to use your rights, don't be a victim of a bad G.P.

Please, have a go with the welfare rights people, they may do just what you're looking for.

 

 

I am in no way qualified to comment on your situation but, yes, I have heard of social phobia. Have a google and I think, you'll find, it's a well recognised problem.

 

 

If you have a specific problem or question, then you have a lot of CAGers out there and you may well find someone with an answer to suit you.

I have suicidal thought nearly every day i was a Gnats hair away in January when my beloved Rottweiler Missy suddenly died i still cant look at a picture of hers without getting upset but GP's just don't want to know. I used to see a Psychiatric Nurse every month for over 3 years but she moved back home so i just didn't bother i thought id just stay in the house out of peoples way but now i feel as though if and when they put me on Jobseekers i will harm someone if iam stressed which will mean i get arrested.

I thought the idea of Jobseekers was you were fit for work so putting someone who isn't fit is rather strange. Ive always said they are not bothered about you being on Benefits all they want is the extra money you get being on the hight Benefits.

 

Regarding my GP i wouldn't P*** on him if he was burning he is absolutely useless. i could Google my symptoms and get a better diagnosis than what he could give me.

Please save your p**s. I can only ask you to find a new G.P. A good G.P. Will deal with any problems they can deal with. If not, then ,they are a gateway to the most appropriate help.

Please use the advice above. Don't be a victim of a bad G.P. Find one that will help you.
