      Hello,

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

      We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Having begrudgingly been with vodafone pay as you go for years, we have now swapped to giffgaff, therefore unleashing myself from the greedy fat cats that are vodafone :lol:

 

They do several different packages ranging from £2.50, up to £15!

 

For £15 we get 19hrs of talk time, UNLIMITED texts, and UNLIMITED internet access, and free calls giffgaff to giffgaff!!! You also get a second sim sent to you for a friend, and the moment that's activated you both get £5 free :)

 

With vodafone for the same amount you only get 200 mins, and 250mb of internet, and 600 text!

 

They're on the O2 network, and are run by "the people"! We're delighted with it!

 

I've changed my number, but you can keep your old number too if you like!

 

Anyway, not sure if this is supposed to go here, but I know not many people have heard of giffgaff, also every penny counts for people at the moment, so I thought I'd share this, it might save a few of you a few quid :-D

Unfortunately giffgaff do not allow tethering on their unlimited package.

 

Their lower usage plans you can tether, you can buy a 3gig data bundle for 1 month for devices such as a dongle or MiFi or smartphone for £12.50 or get their £10 per month with 1gb data, 500mins, and unlimited texts.

 

 

The only one I'd say is good for tethering is Three. Get a basic smartphone, their "all you can eat data" package for £15 per month on PAYG and you also get 300 minutes and 3000 texts. Set the smartphone as a WiFi hotspot and you're laughing :)

 

If you are considering these, go to http://sitefinder.ofcom.org.uk/search and put your postcode in to see who has a close by 3g (or 4g) antenna

Mifi and tethering? Wow, now that IS a new one on me :lol:

 

What on earth is it? Or is it where you can run say your tablet from your smartphones wifi collection?

 

My OH doesn't talk on the phone much so he has the £12pm pack, he gets unlimited internet, unlimited txts, which these are what he mostly uses, and also 250 minutes per month, which is more than enough, as most other people we know are on giffgaff so it's free to talk anyway.

 

By the way, O2 are launching 4g here at the end of the summer :)

Mi-fi : a device to create a "personal wi-fi hotspot" for Internet access that takes a SIM card.

A way for multiple devices to share (by wi-fi) one SIM card's Internet provision.

 

Tethering : use of the Internet through a SIM by a device other than the single smartphone the SIM is in.

So, use of a phone as a 'modem' for another device, or use of a mi-fi.

Does your hubby have a laptop or tablet that he goes out and about with?

If so, does the £10 goodybag provide him with enough for his needs? That pack does support tethering, the unlimited pack does not. (strange I know) or maybe check out Three as their £15 pack supports tethering and has unlimited data usage.

No, we both have Samsung galaxy smart phones, although we do have a laptop and Galaxy tablet, and i do remember my OH saying that we can use the tablet via the wifi on the phone!

 

They're cracking deals though :)

Yup, SIM only.

 

If you've been with both Voda and T-mobile : don't you have an unlocked (or, at least unlockable) device?

They're sim only Nystagmite, also, their customer service is all online in the giffgaff community, it keeps their costs right down.

 

What I like about it as well is, when you get a vodafone freedom freebie package, and you run out of minutes, that's it then till the following month - but with giffgaff you can just buy airtime!

 

Oh and it's really cheap, only 10p per minute to phone abroad! And the voicemail only uses one credit no matter how long you're on :)

edit; no worries, have found the rates. not quite a 10p flat rate. can be more or less, depending on country and whether calling a landline or mob

PS: I've had this for years, and used it so many times, I have well had my monies worth, it's only £7.00 pm, and at the moment they're giving you it free for a year when you sign up to a new one year contract!

 

So all you have to pay is the line rental :)

It's the usual £14.50 line rental cos BT own the lines, then it's only £7.00 a month for unlimited calls to the UK, free to 0870, and to the whole of europe, and a whole other bunch of countries, both landline and mobile, which is great if you're buying abroad too!

I've been with giffgaff for ages the £5 Hokey Kokey which gives 60mins, 300txts, and 20Mb internet can't be beat. By the end of the month with all the extra minutes added I usually have more minutes than I started off with, it's a shame you can't carry them over!

If anyone wants to clock up some points or whaterver with Giffgaff can they recommend me please.... I have had enough of 02 and hanging on for 15 minutes only to be told that one of the offers they have already selected me for is only up for grabs if I do a direct debit, which I cannot cancel or recind under ANY circumstances.

 

Also, with the tethering option I can get rid of my home phone line and the internet that comes with that.

 

What are the speeds like for downloading stuff with tethering?

Three are the only real choice for tethering IMO with their "all you can eat" package

 

Mobile speeds: 3g through HSDPA can get speeds of up to 7.2 meg broadband, 4g up to 20meg at the moment with plans to roll out faster.

In London where the phone masts are crowded the average 3g speed is around 3 meg, which is enough for streaming videos comfortably so this should suffice the average user providing you get strong enough signal.
