      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi there.

I just wondered if someone could advise me with regards to PPI claims.

 

I opened an account with Egg in 2001 with regards to an Egg loan and a credit card.

 

I believe that I was paying PPI on both,

however I do not have records of these accounts.

 

In 2005 I entered a DMP and finished paying off all my creditors by December 2009.

 

Do you think it is possible if I can claim mis sold PPI from back then and how would I go about asking Egg for an SAR

seeing as they are no longer trading?

 

I see they were taken over by Barclays and Yorkshire building society.

 

I also had a Barclayloan and credit card

 

however I still have paperwork for these so I still have account numbers for these.

 

These were taken out in 2003 and 2004.

 

Is there a time limit to PPI claims?

Thanks for any advice given, it would be much appreciated.

Egg is now Barclaycard. Any SAR and subsequent PPI complaint needs to be directed to them.

 

Also, there is no time limit for PPI complaints. It may be an issue getting details for accounts older than 6 years depending on the financial institution, but it's worth sending an SAR to get the information that you need.

I already have an SAR from Barclays with regards to my loan and credit card for them and I have proof that I paid PPI for those. So I would need to send off for it again asking with regards to my Egg accounts? Would they even hold the info on the Egg account from 2002? Find it hard to believe that Barclays would pay out PPI on loans and credit cards that did not originate from them!!

Hi there

I wish to claim back the mis sold PPI on my Egg Loan and credit card which both accounts date back to 2001. I have been informed that I need to send an SAR to Barclays although since researching on these forums, I have heard that Barclays only took over from active accounts in 2006 and at that point my accounts we sent to a dmp. Any advice as to where I am sending the SAR?

Back in late 2009 and recieved in March 2010. No references to any Egg accounts as I have just trawled through both SAR requests on my Barclaycard and Barclayloan. I "think " I may have found Egg account details through paperwork that I had from Payplan DMP although I'm not 100% sure.

thats about the time of the transfer to BC/YB.

 

give BC a ring and ask.

 

problem is

most paperwork only has to be kept for 6yrs.

I've just done a bit more research and have somehow ended up at the citibank website which says that if my Egg Money or credit card was closed before October 2011

then I have to send a PPI questionnaire to Canada Square Operations.

 

I have never heard of them.

 

I take it this is some sort of financial institution.

 

Would I be able to send them a SAR?

 

Or shall I just send the questionnaire with my account details and fill in as much as I can.

 

I also have ready them seem to be very guilty of using pre-ticked boxes!!

Hi lil miss cheeky pink,

 

 

 

This was a credit card my daughter took out in May 2005 and was converted into a loan in 2008.

 

She gave all address links to the account as she did'nt even know the account number of the card

 

She has received all the SAR details requested.

I sent an SAR request to Egg at the Canada Square address on the 11th March 2013.

On the 20th March I received a letter from them saying that I needed to send documentary evidence of my current address as it did not match the address they had on file. They also returned a copy of the cheque I sent them with cancelled stamped across and asked me to provide another.

I've sent off all documentation required but does this mean I know have to wait 40 days from the reply I sent or is it still 40 days from my original letter?

 

40 days is now approaching and no SAR received and 2nd cheque not been cashed either. I did send the 2nd letter recorded but unfortunately I have lost the proof, but I do still have proof for the original letter.

After finally obtaining my SAR from Egg Banking, I am looking to claim back PPI from both an Egg Loan and credit card.

I have heard about Egg using pre-ticked boxes but I don't know when they did this. I took the loan and the credit card out in 2002.

 

The Egg loan was front loaded but I cannot find the reference to PPI on the credit card agreement although 3 months after having the credit card, credit card repayment protector was added to the statements.

 

I have also found another loan agreement which says it will be used to pay off the credit card and because I chose card payment protection, they have included it on the loan.

Could they be allowed to do that?

The agreement has 4 options, all options include repayment including PPI, there is none without it but one of the boxes has been manually ticked and I can only assume that I did that because I signed the agreement.

 

I have a reason for miss-sell, but do I say about the pre ticked boxes also?

Hi there,

This morning I received a letter from Canada Square saying that they are unable to uphold my complaint and consider the matter closed as it was an online sales process.

 

One of the reasons being was that it required to positively confirm that I wished to purchase this during the online application.

 

Now I know that the tick box issue was going on at this point, however it will be extremely difficult to prove that I did not tick this box - I'm adamant I didn't.

 

However, looking at my credit card agreement from my SAR request,

there is no mention of CRP or PPI being added to this account and my statements show no addition of this fee until 5 months after receiving the card.

 

I also had a loan with Egg to pay this card off,

which in the agreement cheekily says that because I had CRP on the credit card it will be added to the loan!

 

I have not received any decision on that loan but I can only make the assumption that will be turned down merely because I supposedly had CRP on the credit card.

 

I mentioned this all on the forms I filled in but I did not provide any documentation as I believed they would look at the information they already have and see that.

 

Any advice on what to do now?

Go for it, they have upheld 2 of my 3 complaints. The 2 complaints were loans taken out in 2002 and 2004.
