Hi everyone,

 

My partner has recently had his home re-possessed, the home was mortgaged by himself and his ex partner. he has now recieved letters from the mortgage company stating he owes the shortfall! all of £35000, no mention of his ex partners name? is she liable for this too? or could she have signed something to say she did not want anything to do with the home, as my partners mother seems to think she took him to court over not paying the mortgage?? i know this sounds a bit blurry but i cant make head or tail of it either, and seem to think once you get a joint mortgage you are both liable whatever the outcome. As surely if he refused to pay the mortgage why did she not step in and pay? hence now home repossesed.

 

Anyway my partner is now going bankrupt, will the £35000 be included in his bankrupcy now the home has been re-posessed and sold on by the mortgage company??? sorry but im new to this and want to help him as much as i can, he has buried his head in the sand and let the bills rack up he is also suffering with depression. He has rougly £40000 worth of debt.
