Scammed by Richard Hall (Capital allowances consultants ltd - Clavering House) investments into Cryoblast Limited 15/16 (Paul Huggins - Clavering House) and Eco Cooling solutions 16/17 (Anthony Fitches - Clavering House).    Mccuminsky - scammed by Capital Allowances after providing his details to Stefan Brown Alpha Tax Consultants (Clavering House) payment made to Eco Cooling Solutions.    Robson - scammed by Capital Allowances - 15/16 paid to Cryoblast 16/17 paid to Eco Cooling.    Myself - scammed by Allan Maxwell - MaxTax (other business Maxwell electronics) registered to Clavering House.   Cryoblast Solutions and Fast Tax - Alan O’Hara    Please note there are two Cryoblasts involved - Cryoblast limited (Paul Huggins and Clavering House) and Cryoblast Solutions Limited (Alan O’Hara also director of Fast Tax).    My return simply said “Cryoblast” another thing that should have been clarified as part of HMRC guidelines before paying out the claim.    Cryoblast limited was already suspected to be involved in fraudulent claims before my investment as Huntly had open assessments issued in November 2018.    Cryoblast Solutions, the same company director as Fast Tax where my money was sent was dissolved before my claims were submitted.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My drivers license picture expired in 2011, before i could have a new photo done my license was stolen (home invasion) i have yet to have it done.

 

The problem, i dont have my old license to send back and its only just come to me that i havent had it done! As i say, i was subject to a brutal home invasion where i was stabbed multiple times and almost killed in my home. I suffer from severe PTSD to this day because of it. Ive only just remembered that the photo was out of date after reading a thread on here about it....it had totally gone out of my mind. I had more pressing issues, ie moving and trying to sort my head out. My license was in my wallet, which was stolen at the time.

 

How do i go about getting a new photo license? I cant send the old one as it was stolen, i reported this to the DVLA shortly after the incident as far as i can remember, as well as the police for obvious reasons. I dont remember them sending me any forms, im sure i looked into it before but found it was a hassle and forgot about it until now!!! I cant even remember if i told them my new address....im sure i did, but i cannot be certain. A long time has passed, and now im worrying il get in trouble for not renewing the picture. I was moved by the council as i could not bare going back to the place i almost lost my life, it was apparently like a scene from a horror movie, blood splattered walls, trails of blood....i was told this by my parents who went to clear my property.

 

Can i do it online? Should i call them? More stress i dont really need, but i feel it is something that needs dealing with ASAP now i realize i havent had it done. Its not one of those things you remember at the best of times, let alone after what i went through.

 

I dont have a passport anymore as that ran out in 2012...so i dont think i can do it online. I have lived at my property for less than 3 years...i dont have the drivers license number as it was stolen

You need to get a form from the post office, D1, Application for a drivers license.

You also need to get new passport sized pictures taken. You willl need your photo signed as a true likeness.

Check the box - to replace my license as it's been stolen & check the box - to renew my license with a new photo.

You cant do it online as you've no passport.

The fee is £20

Signed....like a passport photo is signed by a doctor or other professional?

Brilliant, that you for your help. I have a friend who is a criminal psychologist, i think he can sign my photo :)

Il get the form today and sort out a picture.

Yes professionally qualified people can sign it..police doctors lawyers civil servants teachers MPs etc as long as they've known you personally for two years, not at the same address or a relative

 

btw sorry to read about your horrific experience. Getting your license in order is a wee step back to normality.

Thanks for the kind words, im lucky i am here to even have to renew my license lol. Im sure in time life will go back to normal, still fighting some demons but nowhere as near as bad as i was last year :) Time is a great healer

You may find you don't need to bother with the hassle of getting it signed. As it is a replacement I think you will find in the notes that it says something like "if your likeness has not changed significantly since your last photo...." Don't forget that although you hav elost your licence, there is still a copy at DVLA so they already know roughly what you look like :)
