      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi wondered if anyone could help.

 

Had a mortgage with Britannia in 1996, and had PPI, it was a tick box (done by the sales not us) and not signed for seperately just at the end for the whole mortage.

 

We have no recollection of this, although it went out seperate by DD (although we also had Building Insurance from them, and assumed it was this)

at the time my other half worked for BP and got 2 months pay for each year worked ( had been ther 7 years then so over a year in pay)

 

He also had £35k in a share scheme (which they have noted on the form) and a substantial bonus on top of income (which they noted on form) .

 

I too was working (teacher) we had no dependents.

 

The policy was only on him and I don't know why, maybe as he was first applicant.

 

The policy states that he must have been getting unemployment benefit to claim on the policy,

but as I understand it Unemployment benefit was means tested (pre Job seekers allowance) ,

and with a substantial redundancy payment and the shares (which would have all been released on redundnancy) i doubt we would have got it.

 

I am totally sure we were unaware of the policy as 2 months later we took out a life and critical illness cover.

 

Britannia are wriggling saying that it would have been additional to any payment he got through work, but I am not sure this would have been the case.

 

I have a copy of the policy, (not the schedule) and the mortgage application.

 

There is no other seperate paperwork relating to the PPI. Any help please.

matters not if it was extra to any money he already got.

 

the matter here is it was stealth.

 

pers i'd get that life back too

 

there is not compulsory remit to have any ins on a mortgage other than buildings.

and if you've goth at elsewhere, that too is mis-sold.

They are claiming that we knowingly took it.

 

But with a good redundancy payout it seems ludicrous.

 

Also I can't imagine why we would have then taken out life and critical illness 2 months later if this were the case.

 

We did take that life and CI cover knowingly, although I had health issues and I doubt it would have paid out on me anyway (but thats a seperate company)

 

In shares and assets alone we could have virtually paid off the whole mortgage, so i no real financial danager.

 

The only other debts we had was a renault Clio on zero percent finance.

 

My view is that it is doubtful that we would have been eligible for Unemployment benefit and the policy states

"when you are not registered with the Department for Education and Employment and not in receipt of unemployment benefit"

 

The policy was 1996 (aug) but Job seekers came in Oct 1996 (not totally means tested)

but i can't find anything that says Unemplyment was means tested and what the limits were,

but even with £35k of shares i'm sure we were over)

 

Beacuse it went out as aseperate DD we should have known, but quite clearly we didn't.

 

Also we had an endowment in place from 1989 and I think it is possible we had some illness cover with this.

I think we must have been insured about 3 times over !!

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

K might need teenage daughter to help...lol.

 

I am currently getting contracts of employment etc, that will outline redundancy package.

 

They sent a 2 page letter full of errors.

 

claiming we would need it because we would be in hardship...

err HELLO even though they put athe bonus and shares on the form.

 

Also say they have a seperate signed schedule, so I said okay send it,

also phoned to say not had it,

 

apparently note on file that they don't actually have it (even though they say it is enclosed ...what they enclosed was a signed mortgage document)

with sheet in the middle with tick box for Buildings insurance, and a for your peace of mind.

... tick box clearly not our tick (husband is left handed and writes like a 5 year old)

 

Whilst flexing brain..

 

.also looking at PPI on 1989 Abbey National (santander)

we know we had it (underwritten by Aviva..although they say first payment March 1993,

which I don't understand, don;t remember taking it later)

 

We both had graduated 2 months before mortgage taken out, but cant understand by a couple of years later.

 

I do remember being told by Abbey that we needed negative equity insurance to cover them if house was repossesed,

could this have been PPI or did that really exist.

 

Very little paperwork...
