      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi trying to get some help for my neighbour , don.t go all high and mighty over this but her and her husband have 8 children plus 2 grandchildren all living in a 4 bed house. they are on benefits due to her husband who was taken ill some years ago after he kept blacking out she gave up work to look after him as he was looking after the kids and was told he was.nt to be left alone. he.s been signed off dla this year and now the benefit cap affects othem and don.t know what to do .he suffers depression but don.t blackout so much anymore docs said it was all stress related but can.t be hundred percent. he.s not been found fit for work. she suffers depression after her daughter was raped a few years ago and the boy got away with it she had to cope with all that and gave birth within 2 wks of it happening and moved house six weeks later 5 days before christmas as the family was being bullied about the rape.they don.t live lavish life style they don.t drink or smoke they never go out or on holidays they are in debt and trying to make ends meet.they don.t know what to do she.s not sleeping she crys a lot and all they can think of is that they are going to be homeless in april as they.ve been told they won.t get no housing benefit anymore they.ve been looking for jobs but nothing going for them . its stupid cause this really only affects large familys.what about all the other familys claiming that only have 2/4. kids don.t affect them. they.re only option is work or pay 510 a month out of you benefits can you really see that happening.please do not slag the family off they.ve had a hard time over the last few years and they.ve only made it through cause they got each other and i envy that they go everywhere together and they are dependant on each other.where can they go for help cab was.nt really bothered and said nothing can be done. is this discrimination against having a large family. and what about your rights. i think before these mps make decisions they should accually live on benefits first to see if they can manage.

are all the children/grandchildren dependants?

 

or are they adults? if they are adults, are they working? can any of them contribute to housing costs?

ones in work based learning after is college course was full he.s 16 the oldest is 18 and not working just had a baby and broken up with its father.she.s hoping to move out her self as to cramped its the case of not being able to afford a place herself. they are trying he.s a landscaper he knows what he.s doing but not got the qualifactions sorry about the spelling .and not the right time of year to get that kind of job even tried around the country but he.s been out if work to long no one wants to give him the time of day.he can.t work inside got a phobia about that and will lose is mind if he.s confined in doors he.s always out is back pottering about or in is shed they.re a lovely family and will help anyone .

families receiving working tax credit are exempt from the cap

 

so if either of the parents start work and claim WTC, they will not be affected by the cap

 

this may not have been possible when children were younger, but if some of the children are able to help with caring for their father, maybe the mother could get a job and claim WTC

 

alternatively if the father could be reawarded DLA, this would also exempt them from the cap

hi got taken off dla saying not ill enough its hard to get it now they appealed twice but lost they should of gone and had help with it. where we live nothing really going most things are shutting and so many unemployed people. i.ve got a relative who.s been refused dla and hes git cancer he had a massive op been very ill lost so much weight u can.t reconise him he.s appealled and lost twice also they said he.s not sick enough what a laugh he.s been that suck they couldn.t give him is cemo.

ok if you work 16 hours a week on min wage don.t know what it is so if someone can work it out what else can you get. 1 will they still be able to get rent paid or part.2 what will they.re income be are they really going to be better off. 3 what if one of them decides they need more qualifications and went on a college course to get them so they can get into work will it affect them then.

Some people with non-terminal cancer can't get DLA because the treatment and the effects of the treatment don't last long enough.

stupid he can.t eat he.s had the bit at the bottom of your throught and on top of your stomach removed massive tumour it was stopped him from eating can.t work and sleeps a lot he.s got to be made to eat but can.t keep it down . to make matters worse he lost is neice to stomach cancer just after he found out he had it she lastest not 6 months after finally be diagnoised sorry about spelling.36 she was its been really hard on him cause they found hers to late and feels guilty how can they turn someone down like that when so many others get it for stupid things .

Hi this benefit cap coming into force in april is really not fare.they.re capping peoples benefit but only affects large familys don.t get me wrong its kind of a good thing but they.ve done it wrong.the average low income working family fetch home 500 they say but if that family had more children they.d receive more child/ working tax and child benefit. So why ain.t the average family on benefit being affected .its wrong the bigger your family the worse off you are if they.re going to cap benefits they should affect everyone its not fare .theres so many buisnesses closing down how u suppose to find work .u couldn.t even find a job on the side if u wanted as theres nothing going.

yes as I understand it is to ensure that people do not simply keep on having children and claiming more and more benefits because of it, having children is an individuals choice but they should consider if they can afford to keep that child and not rely on everyone who is working to assist them.

But what about people who.s lost their job and now are affected by this my point is why should just these familys be affected why should a family of 6 not be but if someone as 2 more children are .don.t forget some familys maybe two familys together children from previous relationships they could have 3 kids each. 2 adults 4 children they get around 500 a wk no cap ,2 adults 6 children they get 600/650 say , they now lose their 100 a wk rent but still have to pay it and feed the kids they are now worse off than the other family is that fare .this is point i.m seeing this happen to a friend and he.s been taken off dla but still unfit for work but has to ,no one will employ him cause off health and out of work to long.who.s going to employ someone who suffers blackouts .he.s applied for loads of jobs but not enough experiance.trouble is when he was working u never needed all these certificates that u need now for is kind of work so hes stuck.the goverment is giving hand outs and expensive houses to imigrants and we get nothing we.ve paid taxes my parents paid taxes my grandparents had own business until supermarkets opened everywhere.people get treated unfairly by this eveyone should be affected .they.re giving dla to people who have stupid things that don.t stop them from working or doing anything normal but get extra money to help them i think only disabled people should recieve it people who have something really wrong lost limbs in wheel chairs serious health issues etc.

wish I had something silly then ....shame its bipolar and fms and cant get dla......but still will be paying council tax. I had 2 children and stopped, as I knew that whatever happened I WOULD BE ABLE to get by, and it was a struggle working part time and yes I did get some benefits but I worked as well, I could have had and would have loved more children but common sense and responsibility stopped me.

Agree 100% with Ruby. I have 2 children also, when I was in a stable relationship, and stopped at 2 because I knew that god forbid the relationship broke down, that I'd still be able to go to work, and provide for my children

 

I too would have loved more kids, but I also knew that I'd find it impossible to find a job that would pay enough to provide for the three of us. We have to take some kind of responsibility for our actions too.

 

I also wish that I had something silly. I'm not sure if having Ankylosing Spondylitis, Sjorgren's Syndrome and a right knee that has severe osteoarthritis, and totally unstable due to having no cartilage, and no cruciate ligaments, and a botched patellar tendon qualify me for the DLA that I am currently awarded. I have no missing limbs, and due to my AS are unable to use a wheelchair. Will crutches suffice ?

Ok so why would they need it then you tell me a child wuth autism can get grants for special things in the home new beds carpets and things to make is life easier so why does it need dla .drug users and alloholics get it they also get extra income support whats fair in that.not all cancer people get it so wrong.what we need is someone from a poor backround who.s struggled on benefits to join our stupid goverment someone from our backround who knows what its like to live in poverty cause i bet not one of the mps ave ever had to struggling to pay a bill or decide if they can feed their kids or heat their home this wek.

If u read it tidy i said people in wheelchairs and people like that .my husband suffers blackouts for last 10 years which as caused a brain injury but not serious he.s been taken off dla if he.s a drug addic which is not an illness its through choice hay they can get it .i mean proper illnesses not some of the stupid things like headaches yeah i get them everyday to.

I have a friend who has Autism, he is only a teenager, so knowing what he has to go through, and the emotional and financial support he needs, makes your ignorant and ill-informed comments even more inflammatory.

 

I suggest you have a lot of anger, and need to channel that in the correct way, and not like this.

Ditto, what liverbird said. I have a son with Autism and know only too well how we have struggled over the years.

You are insulting with your blanket statements that just tell us all that you actually have no clue what you are talking about.

Maybe your anger would be better focussed elsewhere.

I have Autism and require noise cancelling headphones to ensure that I don't go out, have a meltdown and then run off. These cost at least £250. Then there's the food I need, (can't tolerate certain foods) etc. Some people with Autism require communication aids. These can cost a few thousand.

 

Maybe you should some time with someone who has Autism to see how difficult their life is. More often than not, they also have other conditions, such as Downs Syndrome.

 

I used to get headaches most days too - more than likely caused by underlying (and undiagnosed) brain condition. Mine were actually migraine - these are so painful and when I have them, I am in no fit state to do anything at all, apart from lay down in a dark room.
