    • Before you do any of the above – Stop! You need to spend a few days reading up on the stories on this sub- forum so that you understand the principles and you understand how to go about making your claim. We will help you – and you have a better than 95% chance of getting your money back – but you need to be in control of what you are doing. We will help you – but this is a self-help forum and you need to have done the reading so that you are confident of each step and you know your way forward. Please don't do anything at all – in particular don't send a letter of claim – until you have done all the reading and I would suggest that probably you will start drafting your letter of claim over the weekend. Also, you haven't told us anything about what has happened. We don't know dates, items dispatched, value, whether they were properly declared, whether you bought so-called insurance, you have been declined reimbursement but we don't know why. If you want us to help you then you will have to give us this basic information. Also the fact that you are an eBay trader makes this slightly more complicated although it doesn't at all affect your chances of success.  Read the other threads on this sub- forum – and especially the pinned threads at the top in order to understand the principles. You also quickly understand the kind of help that we will give you and you will understand some of the draft documents which have been used in other successful claims.
    • Thanks, I'm finishing up the skeleton and hope to have it done today. Will look at statement of case too and get that done over the next few days.
    • But, but, but... They've already sent you a letter of claim, which said... "Should the outstanding balance not be settled by 20/04/20204 we will commence legal proceedings against you without further notice." 🤣 🤣 🤣
    • Thanks DX, I appreciate that.   I've sent off the change of address to them. They should have that by now...

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

All of a sudden a letter drops through my door from someone called MMF Doorstep and Legal Collection Specialists,

who i am told i have to pay £260, due to an outstanding debt which if it ever existed was at least 7-8 years ago in Scotland.

When i phoned Greenwood who told me they sold the debt and my details to they told me to contact this organisation as it was not their problem.

I did and had a very unpleasant conversation with an obnoxious young woman who was asking if i had ever had any doorstep loans,

i refused to confirm as she seemed to be trying to get me to admit something,

i have had two loans in approx 5 years which i have agreed to set arrangements,

and one was with Greenwoods but that has been satisfied for some time and i only have one left which is being paid off as agreed.

This company have now started with the phone calls at all times of the day as i knew they would,

i have disputed this loan with them but fear this harrassment will now continue.

They appear uninterested in anything but getting money from me.

Who are they, if as i think the loan they may refer to was taken out in Scotland

do they still have the right to threaten doorstep collection or do they still have the right to harrass me with letters and phone calls.

What should i do,

i think i saw their name mentioned on here earlier on but as i was not registered

i lost the thread and when i did register i couldn't get it back,

sorry if i'm in the wrong place or repeating what's been already covered,

just a wee bit of advice about these people on what best to deal with them.

can you scan up the letter?

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

or

convert existing PC files to PDF [office has an installable print to PDF option]

.

'

BUT......

ENSURE: remove all pers info inc barcodes etc using paint program

but leave all figures and dates.

.

goto one of the many free online pdf converter websites

it would be better to upload a multipage pdf if

you have many images too rather than many single pdfs

.

or if you have PDF as an installed printer drive use that

or use word and save as pdf

.

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

.

.

i'd stay off the phone too.

there is not legal remit to discuss any debt that way

MMF are NOT bailiffs

and have NO such legal powers.

check your cra file too.

dx

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Thanks for all that but the last was a bit confusing and i don't really understand all the terms you used and what it means i am doing, maybe a wee simpler idiot guide for this idiot might be easier, but a squillion thanks again.I've done a letter and won't respond to the calls, but what to do when they become nuisance calls at all hours. My partner has Myotonic Dystrophy and as her sople carer i am always around so i cant ignore the phone if it rings, help!! Dweezle.

Hi looking in as requested, as cerberus has sail MMF have been chaseing all lot of very old debts through various companies.

These debts are mostly statute barred, ie. no payment or acknowledgment in writting has be made in regard to the debt in 6 clear years (5 in Scotland)

this means the debt cannot be enforced in court and the Office of Fair Trading has guidance on how such debts should be treated!

The Guidance states that a statute barred debt should NOT be chases once the debtor has informed the creditor in writting that the debt is statute barred, to do so could amount to harassment.

I am compiling a mass complaint to submit to the OFT and would like to use your case in this.

As cerberus said use the letter drafted, and amend to Motor Mile Finance Ltd addressed to Mr. Neil Petty (Director) at their head office address.

Certainly use my name in the correspondance you talk about to the OFT, i sent the drafted letter off to the address given but as i hadn't seen this post until now 6.20 i had sent it to the Woodward person, i suppose that it'll get to the new man in charge nontheless, i hope so, i tweaked it a wee bit but very little as i thought maybe that was ok, but gener do you suggest another one to Neil Petty. its a tad expensive at £1.55 a pop, but hopefully worth it. Real names are not a good idea and not approved by CAG.

CAG is well recognised as a site where people get good advice about handling various issues including legal ones. As such, the opposition view these forums and (if they can identify the poster) can get one step ahead of you. Especially on debt collection and legal issues.

This is a good policy in my opinion and one I value highly.

There will be NO real names revealed on CAG with this ''project'' but may be used in strict confidence to nail this submission to the OFT>
