I was told by people on here that either a CCA or SAR would do, so went for the cheaper one.

 

Ah, I apologise.

 

It is definitely a SAR you require and yes, it is more expensive :( however, they would be required to provide ALL data and you should indeed obtain a copy of the signed paperwork within that.. you wouldnt normally get a copy of anything governed by the CCA within the SAR.. but a mortgage isnt and a CCA request was simply a waste of a £1.00 :(

Letter was passed to me this morning from Enact, dated last week..

 

Letter says the usual (carbon copy crap) "We see we havent had a response from you. If you wish to discuss this matter with us, please telephone blah blah.."

 

Given that every letter to them has been sent recorded AND signed for, I can only assume that they have a thief working in their post room.

In todays post was a letter from these guys enclosing a photocopy of two pages from the deeds which showed 5 signatures:

 

1st two were the borrowers.

2nd two were witnesses inclusing their addresses.

3rd signature was a professional witness ie GP, inc address.

 

Is there some DPA thing here regarding sending out a copy of peoples names, addresses and signatures to someone?

Well unless they have a copy of your driving licence and National Insurance Number on their files, then they wont be able to link the information.. will they.

 

So do you recall providing either of those when you obtained the mortgage ?

If they cannot confirm that you are the person on the mortgage, then why are they contacting you in the first case?

It is not for you to assist them in any way in this matter, it is for them to prove categorically that you are the person named on the mortgage, and therefore prove your liability.

 

Sounds to me that one or two of their ducks are missing :o) and they're hoping that you will save them some work by accepting liability
