    • You need a back up plan. If you believe that redundancy is very likely, start looking at other employment options.  Don't leave it until you have been made redundant before looking for new employment. I regularly speak to people who have been made redundant and about mental health. Those who have a positive plan, get into employment quickly following redundancy and manage to maintain their finances. Those who don't have a plan, decide to accept redundancy and a period of unemployment. They end up in a downward spiral, with redundancy money spent, debts accumulated, mental health decline and difficulty finding new employment.  
    • Interested observer here as I'm in a similar situation. People become conditioned into seeking and maintaining a perfect credit score/file, but if your situation is that you're unlikely to obtain further credit for the foreseeable future anyway due to your other outstanding debts, then tanking your credit file now won't make a difference other than you've took back control of your finances.
    • Firstly, I would like to thank everyone for their help in this matter. Since my last post I have received a reply from Plymouth Council Insurance Team concerning my wife’s accident (please see enclosed letter and photo of the offending Badminton post) which they deny any responsibility for the said accident. I feel that the Council is in breach of their statutory duties under the following acts: The Leisure Centre was negligent in its duty of care and therefore, in breach of the statutory duty owed under section 2 of the Occupiers’ Liability Act 1957. Health and Safety at Work Act 1974 (the Act) to ensure, so far as is reasonably practicable, the health, safety and welfare at work of all their employees, and others who might be affected by its undertaking, e.g. members of the public visiting the Leisure Centre to use the facilities. The Management of Health and Safety at Work Regulations 1999 that requires employers to assess risks (including slip and trip risks) and, where necessary, take action to address them. The Provision and Use of Work Equipment Regulations (PUWER) require the risk to people’s health and safety from equipment that is used at a Leisure Centre be prevented or controlled. I would like some advice to see if my assumptions are correct and my approach to obtaining satisfactory outcome to this matter are accurate.     • Talking to them does not reset the time limit, although they will probably tell you it does, they'd be lying. Dumbdales are the in-house sols for Lowlife, just the next desk along. If Lowlifes were corresponding with you at your current address then Dumbdales know your address. However, knowing that they are lower than a snake's belly, you would be well advised to send them a letter, informing them of your current address and nothing else. Get 'proof of posting' which is free from the PO counter, don't sign it, simply type your name. That way then they have absolutely no excuse for attempting a back door CCJ.   P.S. Best course of action, IGNORE them, until or unless you get a claim form......you won't.
    • A 'signed for' Letter of Claim has been sent today so they have 14 days from tomorrow... Lets wait and see what happens but i suspect judging by their attitude they wont reply

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all.

Well ive managed so for to follow the site, reading practically everything there is to read., including the FAQ'S!!

And have got my statments, requested payment, (got standard letter that they will take 4 weeks to look in to it) kept to my timescale and sent LBA, during this time they sent me an offer of £701.00!! Im claiming back £4,315.00.....so obviously i didn't accept, i sent letter saying that i would only accept as part payment but not as final. Have not had a reply since. well 14 days is up tomorrow, as i am on benefits i can't do this bit through MCOL. I understand that i have to go to the court to request this form. i will take my list of charges spreadsheet with me (x2 copies, one for court & x1 for bank, with the added 8% interest) i will fill out the form at the court, do i then give all forms to the court? or do i deliver the form to the bank? also i don't know what date we opened our account, we've had it about 10 yrs..can i put an approx guess down on this form? what ID do i need to take with me (if any) regarding my benefits? Is there anything else i should know about collecting this form in person and filling it in at the court? I was guna print out Bankfodders guide to filling out the form, so i could understand the whole thing a bit better. any advice would be excellent......dont want to go wrong at this stage.....got x2 babies to think about, totally broke and severely in debt.

You will need to fill out 3 N1's which you can download in advance, and an EX160a benefit exemption form(also downloadable), you don't need to do it all in the court. One N1 is retained by the court, one is forwarded to the bank and one returned to you with a seal. Attach copies of all correspondance and shedule of charges to the 3 N1's (well 2 if you like), the court processed my mums EX160a that day and It was a doddle to fill in,

1. My mum rang branch, and HQ faxed it through (apparently)

Thank you for getting back to me so quickly. Where would i be able to download form EX16OA from? I can't say that ive come accross that form on this site...unless ive totally missed it!!

How long do you think it will be from going to drop papers off tomorrow to when i hear something? and am i right in what i have read that the bank normally pay up when they have recieved the papers? although im basing this that i am going to court!!

Mny thanks once again..i will donate when and if i get some money back!!

My reading, and small flirt, with the Halifax is that they are no way near as bad as most of the others.... Not set in stone but would guess you're not too far from the finishing line, albeit every case is different so wouldn't like to speculate!

Print off an extra copy when you've filled it in for your records, I think if you need to apply for exemption for allocation questionare (should it go that far) you would need to fill it in again, and due to the income/expenditure part you can re-enter the same info again.... just in case

hi again.

printed off N1 and EX160.

is there anywhere on this site that goes through the N1 step by step? Ive seen the thread for the particulars of claim. is there anything else. Its just that im really confused after visiting the bear garden. as when i asked a question about the value bit on the form, i was told to put down the amount i was claiming for in charges (£4,315.00) and then something about the 8%intrest, which i do understand and then "intrest persuant to section 69 county courts act off £xxxx or at such rate and for such periods as the court deems just and also interest at the same rate up to the date of judgement or earlier payment at a daily rate of £xxp.

when i requested charges back from the bank, i did not claim the intrest part as i couldnt get my head round it. i didnt like to keep asking questions......but if someone could help me in what im supposed to write i would be gratful. By the way 8% interest on my charges is £745.06. if anyone fancys doing and sums for me that would be grate. im so crap when it comes to figures!!

Hi All,

Well what a nightmare!! First off i couldn't find the stated proof of benefit stuff they wanted, so i went down with a letter from the benefits agency and copies of my bank statments to prove what i was getting............this was friday afternoon.......they wouldn't accept it. So i had to wait till Monday (yeaterday) to spend an hour on the phone and then an hour in the benefits office to wait for a two lined letter i could of done myself.!! Well i handed that in at the court and it has all gone through...........now i wait...............and wait............and wait!!!!!!!!!

I just want to thank you Shaz for your help in doing that form, you were a lifesaver and also thankyou to all others that have helped me so far. Had an idea..........maybe a post could be set up on how to fill out that form.i cant be the only one that had problems with it.........i hope not anyway!!:oops:

well, i will be keeping you informed if i hear anything, will start checking my account daily from tomorrow.early i know, but desperate!!

Mel! Sorry you had so much trouble proving your entitlement to benefit, different strokes for different folks and all that, as I said to you last week all I needed was my certificate from the tax credits and bob's your uncle! At least you have it all filed now! Got your shopping list ready? ;)

Thanks niklowe, ive seen that thread and used it, but i couldn't find anything for filling out the rest of the form, although basic sounding qu's, i was helped answering these so i didn't sound like i didn't know what i was talking about.if you get my drift!!

Just to update everyone.....been checking my account daily, still nothing. I haven't even heard from the court.

Would i hear from the court b4 i get any cash in my account, or could they just pay it in. Waiting for todays post, if nothing, then i will contact the court.

It can take a little longer with the 160 form the courts have to check it out b4 they proceed.You'll then get a certificate of notice that will state when it was sent to the bank,deemed served to the bank.They then have 14 days to reply to see what they want to do.they may let the court know that they wmay intend to defend in full,normally after that your money comes through and you get a letter from the bank not admitting liablity but they prefer to pay up than go to court(you've one then)Don't forget to let your court know that they have settled the claim.Patience...... patience..........is the game.Regards nigel

hi all.

Nothing in the post. Is it worth me ringing the courts tomorrow? Or just sit and wait?

And will they have served the papers b4 they contact me? or do they just let me know when they are going to serve the papers to Halifax?:confused:

Am i likly to get a payout b4 November? (birthday is on the 5th, and would like to go out!!)

All this waiting is driving me mad!!

I woudl think that in the next few days you should get a letter from the court which will include a copy of your claim, on the front will be date of issue and when it is deemed served on Halifax, they will then have 14 days to respond, you can always ring the court and ask what's happening as its been a few days since you filed, however bear in mind they could be extremley busy right now hence the hold up?
