      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi there

 

I did have another thread going but thought since I now have my paperwork from Yes Car Credit/Direct Auto Finance I would start a new one with the appropriate title.

 

Ok so I sent my SAR a few weeks ago and have received a CD rom with all my papoerwork from the car I bought (with my ex partner) in 2003.

 

On the agreement it doesn't seem that I had PPI as it is left blank (number 10) BUT it does have some other premiums on there which I know nothing about which are 'Mechanical Breakdown Insurance' and 'GAP insurance Cash Premium' Is this simelar to PPI and can you claim any of this back for being missold?

 

Does anyone know how I can attach the file so you can take a look?

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

Thanks for that. I have attached 4 sheets out of the paperwork that have agreements on. The rest are all bank statements, letters, driving licence etc. Hope this works.

pers i'd treat it as a PPI misale worth a try.

Thanks dx I'll have a look around the site now. Is it just the GAP I should reclaim or is the mechanical breakdown insurance reclaimable also? Just to clarify, does it look like I didn't have PPI? Sorry I'm confused xx

Ok I'm looking through all the info on this site about reclaiming and am even more confused :???:

 

dx you say I paid £17.73 pcm what was this payment for? The GAP or the mechanical breakdown or both? Was there no PPI on my loan?

 

If I write to them what do I say? Could you put it into words what I should write?

 

Do I have to calculate how much they owe me? How do I do this? It wasn't a straight forward 'paid off monthly for x amount of years because the car was stollen and I stopped the payments resulting in the loan being passed onto debt collection agency who (after a number of years) found me and halved the loan (it was something like £6k and they settled on £3k which I paid off in a lump sum)

 

When the car was stollen the police did find it destroyed but I never claimed I just moved house (I know young and stupid at the time but I'd just split from violent partner and had 2 kids to think about, my life was a huge mess to say the least)

 

So do I still have any chance? Sorry for all the questions but I think this might be a bit too tricky for me to get my head around x

oh dear so a dca spoofed you into paying

on a stolen car when you already had extra insurances

 

you got had there.

 

if your car was written off, you owed nothing.

they would have gotten everything

back already.

 

just dont get caught by a dca again.

The debt payment was made in 2007 and I honestly can't remember who the collection agency was. My Gran actully paid it for me so she might still have details, she paid by card over the phone x

ITS IMPORTANT TO FIND OUT WHO THE PAYMENT WAS MADE TO

 

get your relative to ask the bank

 

i feel a claim is comming as you have been spoofed

 

contact your old insurance company as well and ask did yes car (direct auto finance) receive any payment from them by way of settlement of the claim

I do have all the phone calls from when they were trying to contact me etc,

also it mentions that the car was found destroyed.

 

Shall I just upload everything I have and let you guys take a look?

 

All the phone call records and everything.

 

I don't mind that at all if you can help that's great!

 

I'm at college all day tomorrow but I will try and get it done by Weds

(I have to use someone elses pc to scan etc)
