    • Hi, Thanks a lot for your valuable advice and apologies for bit delay in providing some additional information as requested before. I was also looking at other threads to get some more knowledge so apologies if my questions have already been answered in some other threads and I have missed them. I would appreciate if you can guide to relevant thread to help navigate easily. If I opt to go down the route of availing BS option, I'd find it more convenient if I do it in parts i.e., applying with 2/3 creditors at a time. Is that even possible in my case? I understand that DN might be the best option for me but I am trying to avoid this route as much as I can. I am currently living in a rented property with wife and 3 kids and I am not how this is going to play out in future if we decide to move to some other area. How will DN impact my intention of getting house on mortgage (dream as of today) after 6 years? If I go for DN strainght away, do I have to do it for all debts? for example, can i leave one active credit card out of this DN? what can i do if I go for DN right now but my financial situation improves in 1-2 years due to better job or promotion etc.?  Here are the details of my debts.     • They cannot send any claim forms, they are issued by Northants bulk.  Usual rubbish, and legally cannot be served by email unless you've specifically given Northants bulk permission to do.    Usual claptrap from TM.. See
    • OK but it's always best to scan up these letters you mention so We can decide proper actions/responce/use please scan them all to one mass pdf in date order.  Read upload use the online sites listed Dx
    • Instead of ridiculing them you could point out the embarrassment they will have in the papers if they persist in being in Court with a little old lady. it also won't look good for their landowners since negative comments afffect them too.
    • I'm going to say they haven't complied with the PAP although they did write saying they would be issuing a court claim in their letter they also state I had an agreement with OVO which they have a copy of the agreement and its terms and condition which I have definitely not seen. Also I've technically never had an agreement with OVO but with SSE I didn't even realise they had sold to them until this letter!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello all

 

So far nothing from lewis. Dispute letter sent RD on the 5th. 21 days up next week. Have I by sending this letter exhausted their own complaints procedure and what do I next?

 

SAR request from Santander,

because i am trying to trace records for the years 2000-02 for info on what i have paid re debts.

 

Time left 6 days,

 

went into local branch today.

Was told that a letter was sent out to me on the 24/9 returning £10 cheque and saying that they can only go back 6 years.

 

Firstly have not received this letter, so have appointment next friday and they will put a track on this letter.

 

Now I also said about relevant filing system/court for non disclosure, FOS, IOC (see what how you guys have educated me over past few weeks)

 

My question does this 6 years apply when an account is still active, ie opened account 1996 and is ongoing, switched to Santander from A&L, from thier end.

 

SAR to barclaycard so far request has not be returned so hopefully 3rd time lucky there.

 

Would be so grateful for any advice.

 

I have learnt alot and cotinue to educate myself but still need guidance and advice as a bit confused with it all.

they are saying only for the past 6 years,

 

my argument was that as the account has not changed from 1996 to now where is the data 1996-2006.

 

I am prepared to take this to court for non disclosure but if they have destroyed older data how do i prove that and what can i do.

 

I have read about Barclays having older data on mircofiche, does this apply to other banks?

 

any info/advice gratefully received

The six years rule is from the date the account is closed, this is for money laundering purposes, so HMRC will be interested to hear of this if they haven't kept this info!

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

I think its strange when the account is still live,

or every 6 years all the banks would destroy all data regardless.

 

I was also asked why I wanted it, I said thats personal.

 

My account is still live therefore there would be no reason to destroy the data.

 

Is there any relevant piece of legislation or anything i can quote to strengthen my argument.

 

I have an appointment next Friday.

 

I have to say that I seemed to cause a bit of a flap when i quoted stuff like DPA, FOS, IOC.

 

Not that frightened person who first posted a few weeks ago.

I did have the info bookmarked, but have had to reset my desktop to factory setting so lost the lot.

 

Have a look on HMRC website your looking for money laundering legislation.

Have recieved letter from Barclaycard today.

Its not my SAR they have returned the cheque.

 

What they have said that it is relation to PPI.

 

I may be able to scan up later if a friend can do it.

 

It a sheet and gives some dates etc.

 

It says under Account PPI Flag Y (yes) no premium present PPI start date 1995, this is against two different account numbers.

 

Please any advice on what this means

use a digital camera/phone

 

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

BUT......

ENSURE: remove all pers info inc. barcodes etc using paint program

but leave all figures and dates. {DO NOT USE A BIRO OR PEN]

convert existing PC files to PDF [office has an installable print to PDF option]

..

goto one of the many free online pdf converter websites [http://docupub.com/pdfconvert/]

it would be better to upload a multipage pdf if

you have many images too rather than many single pdfs

.

or if you have PDF as an installed printer drive use that

or use word and save as pdf

try and logically name your file so people know what it is.

i'e Default notice dd-mm-yyyy

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

If you sent one SAR to the OC and they have failed to supply ALL of the info within 40 days, then DO NOT waste another tenner! Inform them that as they have failed to comply with your legal request you have escalated your complaint to the ICO for their investigation and to allow them to fine the OC.

Hi SB,

 

Do you have data of dates and amounts of each PPI charges on the a/c's.

 

If not, send BC a SAR non-compliance letter - http://www.consumeractiongroup.co.uk/forum/content.php?593-Data-Protection-Act-Non-Compliance-Template-Letters - and point out specifically what data you want.

 

No need for another SAR or for another payment.

Barclycard keep returning the £10 and i would need to know the dates/amount of PPI as I didnt know I even had it.

So do i go for SAR once more giving 21 days intsead of 40 as they have already had time to get the data I need, And put notice that i will take them to court for non disclouse if nothing within that time limit.

And how to i begin to make a ppi claim? also would the interest be up unitl today on whatever the amount of ppi paid. Sorry for loads of question

Send the SAR non-compliance letter saying you AGAIN enclose the £10 fee and require dtaes and amounts of all a/c transactions so you can identify PPI and/or penalty charges on the a/c.

 

Tell them they now have only 21 (or however many) days remaining to comply with your original SAR of xxdate.
