      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all

 

I have just been helping my sister check her credit file for the first time.

 

As it stands everything looks fine apart from a default from May 2008 registered by Arrow Global Ltd for £161.

 

My sister did mention that she'd had some issues with someone fraudulently using her name years ago as part of a [problem] with a mail order catalogue

but believes this was resolved at the time.

 

She has no idea what this is for and is not aware of every receiving any type of default notice from anyone.

 

Is there a standard request she can fire off to Arrow Global Ltd asking for details of what this (supposedly) relates to?

Not Really any thing standard on this situation

So send this to the Data Controller at Arrow.

At no time have received any default notice or notice of assignment of any account

to your company.

 

I require your response within 7 days.

 

Recorded delivery.

Thanks for the response.

 

Since posting this I've gone through the detail on her MyCreditExpert file and noticed the Date Of Birth associated with this default entry isn't even my sisters (completely random DOB). This leads me to think this could relate to the issues she had years back with someone fraudulently applying for credit using her details.

 

Will fire off your template and see what happens!

Is this Entry on Experian or is it taken from a site like Credit Score Matters.?

I would check Equifax as well for dodgy entries.

Ok next step when have time, place a notice of dispute on the files

with each CRA.

 

When you have the info come back here and I'll draft a letter for you,

to challenge this.

I'm in two minds about official notice of dispute as from what I understand (most probably incorrectly) any official notice of dispute (even if it succeeds) will automatically create a flag on any future search of her credit file.

 

Is there any truth in this as if there is I would rather try the informal approach in writing first?

Only beneficial the notice states that there is a dispute and

that potential lenders should take note of the dispute when

considering lending.or words to that effect.

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Picking this up again. I got no response first time around (sent recorded) on letter dated 2nd August.

 

Anyone got any recommendations as to how i can up the ante with them and at least get a response?

A few thing wrog there;

1.Arrow g

|Global did nt initiate the default the original creditor did so and AG will have updated when they aquired the debt.

 

2. The CRA is reporting only what they are told and have no way of checking the voracity of info supplied to them.

 

3.They should have course contacted AG when you raised a disputed the entry.

 

4.DID PLACE NOTICE OF DISPUTE ON THE FILES?

Hi

 

Experian have raised dispute statement against this account on my sisters file. This is marked as 'Y1'.

 

They said they are also going to contact Arrow Global.

Should I try Arrow Global again or wait and see what Experian get back?

If I should try them again what's the best approach to try and get a response

The standard answer from a CRA is ''we have contacted xxx and they have confirmed the entry is correct.

So yes try AG again.
