Without boring you with the details, it is precisely the most ridiculous cases that end up being lost - because the Cagger knows the other party's case is rubbish so doesn't do the necessary work on their own case. G24 are well aware of double dipping.  They have either done it deliberately or else have cameras which can't handle multiple visits to the car park which G24 happily leave malfunctioning so the £££££ keep rolling in. Sadly most people aren't like you.  I've just read various reviews for the Retail Park on TripAdvisor and Parkopedia.  Virtually all of them are complaining about these unfair charges for daring to spend time & money shopping in a shopping centre.  Yet no-one is refusing to pay.  They moan but think they have been fined and cough up. G24 are unlikely to do court, but it's not impossible with two tickets. Try to get evidence that you were elsewhere at these times. Often retail parks will intervene, but I've Googled & Googled and cannot find an e-mail address for the place.  Could the manager of one of your favourite shops give you a contact e-mail address for the company that run the retail park? Right at the moment I'm supposed to be teaching someone who runs two shops at the local shopping centre, but I'm not as he has had to go to a meeting with the company that runs the shopping centre, so I know for a fact that these business relationships exist!!!
    • Afternoon DX, The files were in date order. How would I put them into an acceptable format? I'm not that pc literate.  
    • I think you need to tell us what actually happened. Your original post gives the impression that you were taken to court for a speeding offence. But you go on to say that you received no paperwork. So you could not have been summonsed for a speeding offence because the police had no evidence that you (or anybody else) was driving (and it seems you were not anyway). You were probably summonsed (or more likely received a Single Justice Procedure Notice) for "failing to provide the driver's details." You would not normally be banned for this offence if you were convicted - it carries six points. So did you have any earlier points which meant you were liable to a "totting up" ban?  If you were originally convicted (as it seems you might have been) how was that conviction set aside? Did you perform a Statutory Declaration? There is simply too much missing for any meaningful help to be given. It seems as if there may have been an error by the DVLA but before you consider suing those idiots until the cows come home, you need to explain exactly what has happened.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi there.

 

I got into trouble with about 5 payday loan companys. All but payday express put me on

repayment plans straight away and now I only have themselves and 1monthloan to pay back.

 

It's well documented on these forums that express are really unhelpful and really hard to work with. They have refused my repayment offers and I've ended up rolling over the balance about 4 times now (pretty sure I have payed off my original loan amount plus some by now)

 

I just wanted to ask you guys if I have lost my rights for repayment plans as I lied on my loan application.

 

I am on disability allowance and applied for these payday loans as I was struggling around xmas and they spiraled out of control.

 

I put on my payday express application that I was full time employed. They did not bother to check these facts (none of them ever do?).

 

I did tell them the truth when it came to me not having enough for their horrible 'extend fee's'

and since then they have treaten me like sh*t. Hanging up on me, harrasing with phonecalls until i either pay the full amount or roll it over. They have even dipped into my account without telling me (card cancelled and new one requested)

 

Am I in the wrong for lying? Im sure i'm not the only one who has done this as they bombard us with adverts everywhere and I was desperate.

Technically you are, but should the debt ever go to court, no judge will look harshly at you. You were desperate and you took advantage of their viral marketing directed to people just like you.

 

Regardless, if you are still on benefits, you pay £1 a month max to any creditor. ONLY a court can decide you pay more, and if you are on benefits then it is very very unlikely they would raise it. Chances are they would lower it or even tell you to stop paying for a few months.

 

Also remember that the PDL should have done a full check before giving you a loan. SInce they didnt, they have possibly broken regulation.

I know I'm in the wrong but at the time I remembered thinking, surely they'll just refuse me. Then it spiraled.

 

I recently applied for a budgeting loan from the DWP as I'm struggling bad with these repayments. I was approved and after 2 weeks, they put £350 in my account.

I was going to use this to take some weight off and obviously, make sure I have food and rent sorted for end of month.

 

5 minutes after it went in, txtloan took the whole amount to pay off my loan with them. They had not contacted me for weeks. I just assumed the interest was building until it got passed on. I was gutted.

 

Going back to PAYDAY EXPRESS, Would telling them im on DLA and proving it help me at all? They said I don't qualify for any help as I lied on my application form :/

If they took the entire amount off you, you should have gone to your bank and demanded a refund of the money. It is benefits and government granted money. It is NOT to be used for any bills. You should not have let them get away with it.

I obviouslly didn't want to let them get away with it. I was distraught. I sent them a big email saying I was going to the OFT.

 

They phoned me and offered to refund £100 which was the interest added on after the original loan amount and one months interest. I accepted this as I was desperate.

 

Did accepting it then prevent me from claiming the money back? Txtloan closed my account.

I think it did unfortunately. Although someone else with a little more knowledge of refunds might be able to step in and help.

believe me £100 is a lot to receive back as physical money!

Although it's your decision I'd be inclinded to leave it, put it behind you - least it is one less to worry about and you won't have incured extra charges above and beyond what was originally owed

 

Both times I claimed back - I had to fight (quick repayments were about my only stength really) and in no way was there any massive sums coming my way! the 2nd time round was for a pityful amount but nonetheless I can't and won't ever regret what I did

 

You could try the Financial Ombudsman Service but I'm not wholly convinced they do agree to every case.

Although it's your decision I'd be inclinded to leave it, put it behind you - least it is one less to worry about and you won't have incured extra charges above and beyond what was originally owed

Yes It is one loan payed off. Gotta make positives where you can.

 

My main worry Is Payday Express wanting £30 plus some off the balance on Wednesday. As I was already on benefits when I applied for the loan, can I still use that card?

I really dont want to roll it over anymore. Just want to pay off the loan in a way I can afford :/

If you are on benefits, tell them. You ONLY have to make a max payment of £1 a week if you are on benefits. They will stamp their feet and kick up a fuss, but really, theres nothign at all the PDL can do. Even if they take you to court, you can show a judge that you are on benefits, you have told the PDL you ar eon benefits, yet they refused to listen.

 

The PDL would then be in pretty deep trouble with the judge for using the court as a method of debt collection.

No more rollovers, you tell Payday Express you would like a repayment plan based on £1 as you've no income coming in -

you can prove to them you are in receipt of such, and there is not much they can do

 

Please whatever you do, do not give bank statements to this lender

I've seen to many sad stories featuring the 'responsible' lender imo

Section 3 at the top of the page. Take your time and fill them in. The top sheet is for you to work out YOUR budget and should be kept by you.

 

Use the second sheet to send to your creditors as a summary of the info on the first. DO NOT give them any more information than what is stated on that sheet. They do not have the right or even need any more info than that.
