    • quite honestly id email shiply CEO with that crime ref number and state you will be taking this to court, for the full sum of your losses, if it is not resolved ASAP. should that be necessary then i WILL be naming Shiply as the defendant. this can be avoided should the information upon whom the courier was and their current new company contact details, as the present is simply LONDON VIRTUAL OFFICES  is a company registered there and there's a bunch of other invisible companies so clearly just a mail address

    • You can't, but you can (and really should) bring up the point that the lender isn't meeting their legal obligations in selling the property for fair market value. You'll have to do this in court, though. A receiver is bought in by the lender, not you. If they're a registered insolvency practitioner, you may be able to raise a complaint to the insolvency service but there are no guarantees here.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

i sent the first letter to mbna including my £10 they then credited to my account which is closed , i phoned them up and asked whats going on? was told they dont read the letter just look at the cheque and pay to the account ( wouldnt admit that it was a stupid way to do it) but he knew it was

anyway today i got a list of charges wit a letter stating it was fair for them to charge this and a n offer for £350 in goodwill. As soon as i added up the list it came to £756 now this insulted me as its not even 50% , my main question is what next do i ask for it all back , but as i dont have the statments i cant see what intrest i need to add or even work it out( MNBA are so nice to print their intrest rates at bottom af the statments ) any advice would be helpfull even if its re send origianl letter with cheque and id they want again

Did you do a SAR? Assume you did from £10 cheque. Well you need to ensure they send you all the info -either statments or a list of dated transactions, then bang it all in a spread sheet to arrive at charges, interest and compounded or contractual interest. If you charges cover any sort of time period of years then you will find the amount they owe you is CONSIDERABLY more than £756!

Did they send you another form for the SAR requesting proof of identity (yet they offered £350 how bizarre!)?

yes they sent me a form to fill in and also the offer of £300 goodwill, the leter also stated if we do not hear form you within 8 weeks we will asume you to accept this and be the end of the matter.

I will scan the acual letter and post on to this site so you too can read what nonsence they write tommorow morning

just got call back and he said he has no record of letter but will go and pull up my file and work out compound intrest as well and get back to me in next hour but before 5pm

so looks like a result on the way

I think there should be an award for Mr Miney, he has been amazingly helpful and done his job extremely professionally. I told him as much when he told me they were paying up in full. Hopefully , like me ,you'll have something to celebrate tonight,well done!

ok result paul just phoned and told me he had calulated the amount plus the intrest at 24% and wa shocked the intrest more than amount asking for 756 and intrest of 759

said as the total came to 1507.09

and as they had already paid me 350 the amount would be 1157.59

and asked if this was ok so i said yes but looking at the figures they have skimed a bit off not sure why or how they came to that figure either but as origanal ask was just 750 am very happy and said the phone call was confirmation of me being happy with amount and closed the matter. so what would be a correct donation to give when cheques arrive?

cantsay would it not be possible to give them a ring and ask for the extra intrest or did you say that was the end of the matter with them ?

i never assumed i would get any intrest from them so its a bonus to get so much

and i will be donating £100 to site as 5% comes to 75 and jsut want to round it up for all the good work that get done here

just seen on mbna site that can get 0% till nov 2007 do you think that they would say no to me because of asking for charges back as i would like to try some stoozing now i am in a better finacial position
