    • Well done with the photo. Of course the signage is insufficient.  PPM are not interested in competent management of a car park, they are interested in catching drivers out so they can issue their PCNs. For a start, according to their trade associations' Codes of Practice, they are supposed to have signage at the entrance. Any e-mail reply from the company and whether they will/won't/can/can't get the invoice cancelled?

    • I went back to the area, this photo is taken on entry. My vehicle was parked in the first space on the left.    Would you say there is sufficient signage ? It’s different to the street view as one sign is missing. The sign nearest to where I parked is 2.23m above ground! So even if the car had been reversed parked in front of it, I don’t think it could be seen. PCN PPM.pdf

Meanwhile, I really wonder whether the default date – as being the starting point of the six years – something which has been decided in law. It has always seemed to me to be extremely unfair. According to the limitation act, the six year period begins from the date on which the cause of action accrued. This normally means that the breach of contract occurred. Section 6 of the limitation act says that in terms of loans, the cause of action begins on the date that the debt was "demanded". Over the past two years this has come to mean the date that the default notice was issued – but I have to say I don't find that very satisfactory. If you received demands for payment before then then I don't see why section 6 shouldn't refer to that date. Did you not receive any correspondence at all in 2017/2018? What was the value of the original loan – and how much you pay off? I see that there was some kind of instalment agreement. Tell us about that. See what my colleague @dx100uk says but anyway, if I were you I would send off an SAR immediately both to the claimant and also to the original creditor. It costs you nothing. There is no downside. Get in the post straightaway with some kind of utility bill establishing your identity. You can even include a copy of the claim form as well as proof of your identity

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

As previously stated, report them to the OFT - that email is out of order, you have been trying to come to na arrangement and they have continued with autopilot. I sincerely believe this lot is a one man band operation!

sillygirl have reported them email i had back of oft is on post 46 and i agree with you they try and deny that they are the same going as far as putting it on each others contact page they they are different companies

They cant dent it as you have written proof. The OFT has a lot more resources to investigate with when they get going. They can even tell the PDL to forward ALL their records to them.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Hi everyone

 

 

I dont know if you can help me with this or not.

 

 

Basically i took a loan out with Toothfairy which then got passed to the famous NDR and then onto MH Bailiffs. I was put onto a payment plan of £40 a month which i have been paying for the last 3 months sending my payment via bank transfer and the 3 previous payments have gone through fine not a problem.

 

I got an email today asking me to contact them which i have. They have said that last months payment has not been received even though whilst i was on the phone to them i logged into my online banking and the payment had gone out same date same time as always.

 

They were having none of it saying the payment had not been received and therefore my account was back in default.

 

I have contacted the bank and they have said the payment has been made the same as usual and has cleared no problem. MH Bailffs are asking me to send a copy of my bank statement showing the payment made but they do not accept emails and want me to post it to a PO BOX address which i dont really fancy doing.

 

Do you have any advice for me?

They are a nightmare personally i would ignore them and carry on paying as usual i am still trying to sort mine out i have not paid them a thing i still get emails every 2 days from them threatening me and telling me they will send an agent out to me in the next 3 days this has been going on for months and months and months and they have never been out to my address they just like to use scare tactics on you

Also i have sent letters to them at the po box by recorded delivery and had them returned to me as there is no one there to sign for the letter if you were to send bank statements then you would have to send recorded for your own peace of mind and records so they would not recieve them and you would still be hounded by them they are a joke report them to oft (office fair trading )

I have received yet another email today to say they haven't received this months payment also and they will be adding interest on and all the usual crap.

 

Thing is I have been on this payment plan for around 7 months and the first 5 payments have been fine but the last 2 they are saying haven't made it i have also contacted the bank and they have confirmed it went through fine.

 

I can do without the hassle of them adding interest back on as I have paid them money they are just gonna cancel out with interest.

 

Is there anything I can do to combat this?? I have contacted Northern Debt Recovery and Marshall Hoares the same company and they keep saying send bank statements to the PO Box or Fax them over and I'm not comfortable with sending personal bank details to a company with this reputation

I pay them £40.00 a month by Bank Transfer and the first few payments went through fine. Its only lately they are saying they are not receiving them. I don't really know what to do now. I have changed my number so they cannot continue to phone me and hang up when i answer.

 

Any advice on were to go from here? They don't want to know when you phone them and im sick of them saying they are MH Bailiffs then emailing me from NDR?

Can you not contact barcleys bank which is ndr/mh account is.and get them to confirm it went in their bank.from your bank?
