hi andy

no black horse are not original claimant, the dispute started with CAPITAL BANK, who did not comply with cca and sar requests, they passed to a couple of dca who returned it to capital as it was in dispute.

then capital passed it or gave it to bank of scotland who passed it to dca who returned it to bank of scotland whp passed it to black horse who in turn passed it to dca before it ending back with black horse and court.

i know its complicated but none of them can answer my requests for correct paperwork . black horse are trying to bully it through in thier favour

 

so i dont know how many assignments have been made but witness statement said the notice of assignment was in june 2010 but in the notice of assognment they sent to me it is dated january 24 2012, so they are in fact sending me the notice of assignment a month after they claim they sent me the DN.

i had a tough day in court as BH put a barrister in against me and she pulled all kinds of tricks but in the end I wo n !! on two points and won costs against BH not a lot but i walked away with my car and BH were refused the right to appeal as well so job done. now i intend to challenge them for entering data with credit agencies without having an enforceable agreement in place

 

if you are in a similar position you are welcome to my skeleton arguments and defences if you need them

Congrats on your win! Hopefully someone can further advise you on the above, but I thought placing adverse data on credit agreements (even those which are unenforceable) is likely to be OK as per Mcguffick?

 

I am *not* a CCA expert, mind you, so don't take my word for it. Please :)

That is fantastic news Joe. Really cheered me up. It so often seems that Judges accept everything a lender says without question yet yesterday Bank of Scotland were fined £4.5 million for mal administering 250,000 mortgage accounts!

 

Which were the two points that the Judge accepted?
