    • Worth noting that all of these firms - either the alleged EIS investment, the rebate company themselves or the payee were all registered to the same address. Clavering House is 3 miles away from HMRC Benton Park view offices.   Wardrop - unfortunately unsuccessful due to late appeal - assessments opened by HMRC in March 2019. Scammed by Richard Hall (Capital allowances consultants ltd - Clavering House) investments into Cryoblast Limited 15/16 (Paul Huggins - Clavering House) and Eco Cooling solutions 16/17 (Anthony Fitches - Clavering House).    Mccuminsky - scammed by Capital Allowances after providing his details to Stefan Brown Alpha Tax Consultants (Clavering House) payment made to Eco Cooling Solutions.    Robson - scammed by Capital Allowances - 15/16 paid to Cryoblast 16/17 paid to Eco Cooling.    Myself - scammed by Allan Maxwell - MaxTax (other business Maxwell electronics) registered to Clavering House.   Cryoblast Solutions and Fast Tax - Alan O’Hara    Please note there are two Cryoblasts involved - Cryoblast limited (Paul Huggins and Clavering House) and Cryoblast Solutions Limited (Alan O’Hara also director of Fast Tax).    My return simply said “Cryoblast” another thing that should have been clarified as part of HMRC guidelines before paying out the claim.    Cryoblast limited was already suspected to be involved in fraudulent claims before my investment as Huntly had open assessments issued in November 2018.    Cryoblast Solutions, the same company director as Fast Tax where my money was sent was dissolved before my claims were submitted.

    • I am reading the thread now and think although its probably very similar to my predicament,  I have no way of obtaining the terms anymore due to MyParcelDelivery having being dissolved and their website not being active now. I have nothing to quote from and they didn't send me a copy at the time of order, the website that I believe they reinvented themselves as P4D has terms I am looking at now but however similar they may be I wont be able to quote from them in this case. Thanks

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

About lawyers - they can never win. If they win a case the client thinks its because they had a good case and would have won anyway. If they lose the client thinks its the lawyer's fault.

 

I know loads of lawyers (all high street practitioners) and they are to a man and woman dedicated and committed people who provide real help to the people in the commuinities where they live. There are even some lurking around this forum offering help and assistance to all of you so don't be too quick to knock them :)

Hi Everyone

 

I am now on the next leg of the journey.I received LloydsTSB defence this morning from Matineau Johnson signed by Heather Leeson all 4 pages of it complete with email address and direct telephone number. Are they trying to tell us something.

 

Anyone else got their defence papers I wouldn't mind comparing the defences.PM me and I will let you have a copy of mine. Dave/Bankfodder would you like a copy too? Any advice on my reply to the defence most welcome.

I received my Court Allocation Questionaire this morning which I have to complete and return to the court by the 1 June. Any advice before I complete it ? Every comment is welcome.

 

N.B. do i have to send Llloyds a copy of the Allocation Questionaire ?

Hello All

 

I receive my court allocation questionaire I checked it over. I needed answers to a few questions.I phoned the court I spoke to a very pleasant informative young man who told me I didn't have to let Martineau Johnson have a copy it. He also told me that I could put whatever information in the box marked H and continue on the reverse. I could also include any papers letters documents and a statement telling the Judge what I done to negotiate to prevent this going to court.

Yet another example of LTSB dragging their heels until the last minute - surely there must be some pattern being noticed by the courts here. If that is the case then pressure should be put on the court to ensure that Lloyds do not prevaricate and cave in at the last moment as it is the banks "clients" that are suffering from their undoubted "brinkmanship".

Hi if you take a look at the last few posts in my thread it will show you how much they don't want this to get into court .

 

I checked your thread out, I got almost the same letter mine said CLAM too so much for individual letters Ha Ha.

They offered me the full amount but I will not accept their conditions. Why should I ? They made my life hell.

What quite a few people are doing is crossing out the conditions which they do not wish to agree to (IE: Confidentiality and full and final settlement of any future claims related to penalty charges), signing and returning the letter. Failing that, a letter along the lines of those MJanet wrote should do the trick ;)

well done, its good to hear some positive results, although I have to agree with the sh**ty time scale, if they know they wont go to court why not pay up before and save themself the extra costs.

Surely some kindly judge will have to take them in hand sooner rather than later.

Thing is, if they pay up too fast it could encourage even more people to go after their refunds. At least with the Lloyds claim-back being this long a process you have to be dedicated to get anywhere.

Hi Everyone

 

 

I think I am at the last hurdle now after bouncing the ball back and forth with Martineau Johnson. I may finally be on my way to getting my money back. A figure has been settled on with no confidentiality.

 

The buggers are telling me it will take 10 days for the money to be transferred to my account, yet they take ours at the stroke of midnight and often before the due date. I queried this with them and all I got is it’s not the same ha ha! I don’t think so they are once stalling dragging their feet. I wonder if they have X amount of Lloyds money in their account making interest for them. I will keep everyone up to date.

Plus a letter from Martineau Johnson asking me to inform the court that the claim had been settled. No way I am doing that until the money is in my account.
To be honest, you should write to them and state this quite categorically.

 

"Dear Mr So and so, under no circumstances will I write to the court, and indicate that my claim has been settled, until such time as your client has deposited, and cleared, the agreed monies within my account."

Hi Krystyna,

 

They are surely introducing an unnecessary delay. When you contact them, you may wish to ask them why "scorpio_manuk" was paid by Lloyds TSB 'Compliance' department within a couple of hours of agreeing settlement.

 

If you get nowhere with this, I have no other suggestions, you may just have to accept it.

 

You could finally point out that the settlement should take account of this 10 day delay, i.e. it should include 10 day's interest at your daily rate.
