Not sure probably  Did you receive a Default Notice from the original creditor? Again can't remember but probably    Have you been receiving statutory notices headed “Notice of Sums in Arrears”  or " Notice of Arrears "– at least once a year ? No   Why did you cease payments? Changed supplier   What was the date of your last payment? Never    Was there a dispute with the original creditor that remains unresolved? No   Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan? No  
    • Their FAQs state - Cancellations and modifications If your booking has been cancelled, Booking.com refunds you immediately. The processing time may take 7 to 10 days and depends on your bank. If you have questions, contact your bank directly. I'm a regular Booking.com and AirBnB user.  The former have never cancelled.  The latter have and my money was refunded immediately (not that that helps you as we're not talking about AirBnB!) Best to check with your bank and see (a) if you did pay in advance and (b) if it has been refunded. Also, have you received a message from Booking.com officially stating the cancellation?
    • I'm not up to date with the Legal Aid rules but I'm not sure that many people qualify. HB
    • You question timescales a bit in thread - From my experience, defaulting everything and ignoring all non PAP letters, while making no payments: - 18 months to LOC - further 18 months to be at court Most are still silent 3 years in though!. If making token payments, court, if ever would be 4-5-6 years from now - Hope that helps. My debt is similar, I started it 2021 and wouldn't believe I'm already over half way through default period. You need to make the decisions but follow advice already given in this thread, and you will be fine. Best time to plant a tree was yesterday, second best time is today. Good luck BT

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

HI I have received a letter from equidebt of a debt from aktiv for a store card I had over 10 years ago. I was not aware of any amount owing on this nor have had any correspondence in the last 10 years, I have a clean credit file and I have rang them and told them I dont know anything about it, he said they will go back to Aktiv to get a copy of the contract the debt is from 2003 apparantly. does anyone know what I should do about this, will I have to pay it, they have already written twice and said they may instruct someone to come to the house. Any advice please. sorry if I have posted this incorrectly am a bit lost on the site.

Sounds to me like this is Statutory Barred.

 

If there has been no payment or written acknowledgement of the debt by you for a period of 6 years (5 in Scotland) then it is SB.

 

Do not talk to these fleecers on the phone......they are trying to spoof you into paying something that is SB

I did talk to them on the phone, I acknowledged my name and that I had lived at the address they were stating 10 years ago. I told them I didnt know anything about it. If it was 2003 will it be statute barred and if it is are they obliged to leave me alone or can they continue harrasing me even if I send them a letter stating statute barred?

Hi

 

If you are in Scotland then the debt is extinguished.

 

Otherwise, although the debt is still there, it cannot be pursued in court....SB is an absolute defence.

 

If you are sure that 2003 was the last payment then yes it is SB and you should send them the SB letter and tell them that you will not be paying and that they must now leave you alone under the OFT debt collection guidance.

If you are absolutely sure it’s SB, send the letter, making it clear you will not be paying and that any further contact will be regarded as criminal harassment and reported to the OFT and the Police as such.

I ma not sure it is 2003 he told me that over the phone. I guess I should just wait now and see if they send me the original contract and see what thet date on it is and when the last payment was, is that correct? he did ask for my phone number and I said no to write but now I am thinking they have those caller displays so he may have written it down. He said he would put it on hold until they receive the contract. Will this affect my credit rating? Thank you for you help. Much appreciated.

See what they come up with in writing.

 

Have you checked your CRA file to see what it says about this debt....I would.

 

Also bear in mind that it has not been unknown for DCAs to come up with phantom payments to accounts so don't trust anything they send you about when the last payment was.

 

And makes sure you stay off the phone. If they call do not answer their security questions and say "in writing only" and hang up

yes they asked for my date of birth and I said you cant possibly know that. there is no mention of this debt on my credit file up until about end of dec 2011 that was when I checked last.When you say dont trust them should I only respond to a copy of the contract or whatever they send me?

If its not on your CRA file then it has dropped off and I would bet that it is SB.

 

Even if you had made a payment in 2005 or even in Jan 2006 it would still be SB

 

You have two choices...either send them the SB letter as previously mentioned or ignore them until they come up with something worth worrying about.

Oh I see, What letter should I send them is there a template available please? btw I have since moved the reason I receive the letter is through post redirect I did not give them my new address, but I dont want any one getting hassle at my old address should I give them my new address?

Don't forget to tell them that they must cease all activity now (as detailed by donkeyB earlier)

 

Its up to you whether you give them your current address or not...personally I wouldn't as there is no need. On an SB debt they can't do anything.

Hi , had the usual letter from equidebt not sure what it is for.. i stupidly took out a payday loan 1 year ago it got passed on to dca which i paid off in full and have a letter stating that, so dont think it could be that? the only other debts i had was 11 years ago which was a credit card and overdraft. I have been out of the uk for 9 and half years and returned 2 years ago do you think they will be chasing me about these old debts.... any ideas???
