    • Hello all, following this thread I opened about one year ago: I waited a year before posting again about this, because sometimes you can find similar discussions but with no follow up, and when someone receives such email may go into panic and wants to read something comforting. Well, my last email to that 'kind person' was dated may 2023 and it said that the ip address was not belonging to my company, nor to any person working in my company, and that I didn't know how they could link geographical coordinates to my company. My last sentence was that they could request to the internet provider releasing that ip address name and surname of the owner, and that they would find that it didn't belong to my company (and btw...this was the truth). I also added that I had to report him to local authorities if he continued to write to me or to any of my colleague. STOP. He still replied that geographical coordinates are provided by wifi triangulation. Pathetic...this email had no reply from me. From then, no new email from these people. So advices are still valid, ignore totally.

    • ok as to date your have not involved the finance co. as it's THEIR CAR, i would be writing a simple, brief letter to them, outlining what to date with bullet points has happened and asking them to get it sorted FOC to you.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

no i get paid 3 days after the eviction date and i m worried about rental bonds and stuff if it goes against me work have been really supportive thoght told me to take rest of week off to get my head together.

ok i have been offered a loan by a family friend which would clear the arrears in full £2040 do you think i should still go to court on thursday and see what judge says and possibly reduce my payments or should i take the loan and stop this.there fine lending me the money but i,d rather not and try and sort this out my self if the judge doesnt go in my favour i can go round the corner to the bank and pay the arrears in full

My advice would be to go to the hearing - I'm sure you will be able to stop the eviction with your N244 application. As you say - if it doesn't go in your favour (unlikely) then you can pay the arrears anyway.

ok in court at 10 am tomorrow would just like some pointers as to what the judge is likely to ask and if ge offer me some type of deal before the hearing should i accept or still go into hearing . also will ge try and paint me as a bad payer by dredging up my payment record and will the judge take not of this or just look to the future ability to pay.

If the lender's rep does agree to your arrangement before the hearing then yes you can accept but still go into the hearing and make sure the judge knows about it. Obviously only accept something you can afford though.

 

I suspect they may well try to talk about your payment record, as that is what forms the basis of their case. I think it depends on the judge to a degree, you might get a bit of a telling off, but if you have proven what you can afford going forward and therefore the offer is a realistic one then that is the main thing.

Don't let the lenders rep pressurise you into a deal you can't afford - if they won't agree what you have offered, just tell them you'd rather let the judge decide. Do you know if there are any duty legal advisors at the court tomorrow?

hello i won my case with the help of the duty legal officer who was great.nobody from ge turned up but they sent a letter saying they would accept my offer of £150 plus normal payment. the judge said pay £100 i think he was a bit annoyed ge had accepted my offer but not told me.thanks for all the help and if anyone is worried about going to court please dont be dont do what i did and be pressurised into payment plans by your lender i can see now that they didnt want me to go to court becouse the judge would accept a much lower payment. i think as long as you have proof that going forward you can pay they will help you.
