    • Please go back and read my message posted at 10:27 this morning @jk2054. I didn't say that I wasn't going to provide documents, only that I will upload them to an online repo that I am in control of, and that I would share links to these. You shall still be able to read and download them no different from if they were hosted here. And, the issue I have is not so much with hosting, but using an online pdf editor to create a multi-page pdf, again I have discussed this that same message.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello everyone. I am new to the site and am hoping that someone can give me some advice please. Back in June I had a letter from HFO Servises saying that I owed £2,000 to Barclaycard. This came totally out of the blue. I immediately wrote back stating that I had never been a Barclays customer and had certainly never had a Barclaycard. They wrote to me again informing me that they had my name and date of birth as proof. I again wrote back stating that this was nothing to do with me. To cut a long story short I have still received nasty threatening letters from this company, the last one being around 6 weeks ago. In the mean time I have spoken to Barclays and they have confirmed that they hold no records of me on their system at all. ( I double checked as I feared I was going mad and needed complete reassurance). I have reported this to the Consumer Credit Agency and I have also called the National Debt Helpline. The very nice guy there informed me that as this alleged debt goes back to 2004, the chances are it would be statute barred by now. I am worried sick that another letter will drop through the door any day now. Please can someone help me. Thank you.

Forget the SB issue – if it is not yours, it is not yours. End of.

 

Suggest you contact your local trading standards and also email your story as a matter of urgency to Polly Ashford at the OFT – polly.ashford@oft.gsi.gov.uk – and dig out the ‘prove it’ letter from the templates section. Send recorded.

 

The OFT debt collections guidelines state that they MUST stop collection activity and investigate your complaint. May be worth demanding their complaints procedure too.

 

There’s no point in issuing a CCA request, because this implies you know something about it. Stick to your guns if it definitely is not yours.

They are doing the same to me but I have reported them to the OFT and trading standards, contact the OFT on

08457224499. The more people that report them the better as there license is 'minded to revoke' because of there actions.

I have contacted Polly Ashford at OFT by email and explained the situation. I am having a little difficulty uploading the letters, but will seek some help from a friend who is a little more 'computer minded' than myself. Thank you to all of you who have given advice. It is awful when you reach the point of dreading getting up every day because of these people. Thank you again :)

Why would anyone possibly dread getting up in the AM in their OWN home??

 

Because of some random computer generated letter littered with untruths and misleading people with empty puerile threats? And the fact that the recipient owes no money to boot!

 

Just make the complaints, ignore these fools, it is simply a computer sending you threats, you are under zero obligation to respond to what they send. If you do send them anything then they will harass you further and put a mug marker on your file, they are purely feeding off your lack of knowledge and fear of what you think will happen, it won't, it never does, forget them.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!
