hi can any one give me some advise i have sent myLBA letter on the 20 sept not heard anythink yet.but the ni claims form .say.s[ brief details ]what do i put there and also[ particulars of claim ]what do i put there i have never do nothink like this before and also before i sent this claim .i keep asking this is it all right for overdraft charges regards veronica:oops:

Hi Veronica

 

This is a copy of my claim form, this was done on MCOL, I copied this from somebodies elses post who has now won their case. You just need to change it to your details (account number, interest, daily rate, etc). Also if you go to the library you will will find a templete in their to help you with the form.

 

Claimant had accounts x and

x with Defendant conducted on their

standard terms and conditions. Claimant is

claiming the return of money (£3678.20) taken by

Defendant in charges over 6 years. The

Defendant's charges are a disproportionate

penalty and therefore unenforceable as they

are contrary to common law. They are also

invalid under the Unfair Contracts Terms Act

1977 s.4 and under the Unfair Terms in

Consumer Contracts Regulations 1999.Para.8

and sch.2.1.e. In the event that the charges

are not a penalty they are unreasonable

within the meaning of the Supply of Goods

and Services Act 1982 s.15. Defendant has

declined justification of charges despite

repeated requests. Claimant claims interest

under Sec.69 of the County Courts Act 1984

at a rate of 8% a year from August 00 to

September 06 of £1226.92 and also interest

at same rate up to the date of judgment or

earlier payment at a daily rate of (£0.81).

Payment is required in the form of a cheque

If its the N1 form then the particulars of claim template is in the library. The N1 form allows you to state more as the word limit isn't restricted like the moneyclaim.

 

 

Brief details of claim

I am claiming the return of money taken by the defendant in the way of charges over the last xx years and xx months plus the interest they have levied on those charges.

 

 

Concerning overdraft charges do you mean unauthorised overdraft charges or just like a service charge?
