    • Good afternoon Stu. Many thanks for taking a look at my defence pdf and giving it the ok.   On the claim form Question 3 they ticked yes   'are you the claimant asking for an order that the defendant pay the cost of the claim?' . So it looks i can only hope the judge sympathises with my appalling treatment by the landlord and their agent.   As i previously said i was so desperate to find a place due to my previous eviction 7 months ago, i took something that i was not entirely happy with. If you look at the pics on my attached pdf, you can see masses of weeds at the front, side and rear garden, the back grass needs professional equipment to cut it, countless dead insects on many places including the kitchen window, same with the disgusting cobwebs. Regarding the garden The girl told me she would talk to the landlord but nothing was ever done, i have not touched the garden and its still in the same mess except there is lots of dead grass. I thought all agencies would get a cleaner in before a new tenant moves in but it seems the landlord was too tight to get this done. I was left with no option but me and my daughter to clean this up. Stu do you think its worth making the judge aware aware of the mess i faced when i moved into this house? pics of poor condition.pdf

    • Hi Lookinforinfo Thank you for your words of encouragement re the mortgage. But sadly we have no pension to fall back on, we have always been self employed and never in the position to put extra money away into pension. But we are dealing with that. We are not in arrears but trapped by a dormant lender! Anyway yes there were 2 seperate NTK, date of infringement on one was 23/4/21 for my parents and the other was 28/4/21 to my husbandm (this is the one that was discontiunued). They were both issued on 26/5/21, well after the 14 days. Please see my parents NTK questionnaire below, I have uploaded this and pictures previously on this post. But if you look at the detail, this is why I say they are more or less identical in every way. Apart from I think my parents were in there for a minute less than my husbands car.  They entered at 16.58 and exited and 17.15. I am waiting to see my parents this evening to get the court notice to allocation for her one in August 2024.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,

 

This isn't a letting jproblem but something wrong with the estate agent I instructed to sell my home... Sorry if there is another sub forum, I couldn't see one for house purchases or sales. Also my apologies for the length of the post.

 

I instructed an agent back in August on a single agency 16 week initial contract. From start to finish they have been a nightmare, with the property not being advertised on all of the websites they say they will. I've had to contact them on a weekly basis to chase this up, and they have not secured any viewings at all. The relationship has soured somewhat, so I decided that I sold not allow the contract to roll on after the initial 16 week period, and as termination would be required in writing, I sent a letter to this effect earlier this week.

 

They replied stating that according to their terms and conditions I would have to pay a £50 withdrawal fee which I'm arguing against due to the problems experienced... But there has been a further development. They stated that 15 days notice is required to cancel, and I stated in my letter that the contract would not be terminated until the end of the initial period, at the end of this month. They have in the last day withdrawn the listing from all of the websites and also had the sale board removed from the property.

 

Now, as we have already moved I spoke to my neighbour to confirm this, so I want to pick up the keys that I gave the agent on Monday. The issue is whether they will refuse to hand them over until I pay their small fee. Technically I think they have definitely breached their own contract as they have withdrawn the listing far earlier than the contract states, and also way before I requested it. The thing is, if they do withhold the keys is this still a civil matter, or can I call the Police?

 

I'm hoping to still resolve this amicably but I doubt at the moment that this will happen.

I would say refusing to return your keys would be regarded as a civil matter.

 

I've never heard of an estate agent charging a withdrawal fee - is this in the contract you signed even if you stay the full 16 weeks?!

 

If it has failed to get any viewings despite eventually being on the agreed websites, maybe it is overpriced for the current market? They are supposed to judge the price but they take your views into account too - did you push them too high?

No, the price was reasonable for the area. My personal view is that they didn't really push it at all. Although the contract is only a few paragraphs long, the withdrawal fee is noted. I collected the keys earlier after a 4 hour drive, and nothing was mentioned about the fee. They've removed the listing completely along with the sale board, so as far as I'm concerned they're in breach of contract. Hopefully they won't push for the fee but if they do I'll take it further.

I doubt they will bother for £50 - I think the lesson though is to read the contract a bit closer.

 

My friend put his house up with a big agent - he agreed the fees for successful selling, then the guy shoved the contract into his face for signing with a higher fee written on it!

With hindsight I would have examined the short contract more closely and compared it with other estate agent contracts. Which have one on their website as an example. I at least have the keys now, so that's the main thing. It is a shame they were so poor, I really wanted to use a local business and for my money to help them rather than use a bigger chain. After doing some more research I think I shall try Sarah Beeny's new website, Tepilo for a month or so and see what happens.
